Brennan considers legal action to stop clearance revocations

Former CIA Director John Brennan said Sunday that he is considering taking legal action to try to prevent President Donald Trump from stripping other current and former officials’ security clearances.

Speaking on NBC’s “Meet the Press,” Brennan said he’s been contacted by a number of lawyers about the possibility of an injunction in the wake of Trump’s move to revoke his clearance and threaten nine others who have been critical of the president or are connected to the Russia probe.

“If my clearances and my reputation as I’m being pulled through the mud now, if that’s the price we’re going to pay to prevent Donald Trump from doing this against other people, to me it’s a small price to pay,” Brennan said. “So I am going to do whatever I can personally to try to prevent these abuses in the future. And if it means going to court, I will do that.” […]

Brennan’s legal warning came as other officials joined the growing chorus of critics — now more than 75 intelligence officials — denouncing Trump’s security clearance threats, saying they have a right to express their views on national security issues without fear of punishment. …

Theory cannot over-rule the constitution.

Executive actions can only be nullified by congress, or the next chief executive.

Take your worrywart nonsense elosewhere.

That “freedom of speech” argument connected to security clearances is strange. How are the two even related? Brennan can go out and disrespect President Trump the same as he had been. Jerking that clearance away sure made Brennan and angrier blabber mouth.

It seems like the first amendments is pulled out every time a liberal or other malcontent doesn't get their way. The whole amendment consist of less than 50 words and the first five words make clear that it only prohibits Congress' law making power. There is no restriction on the President, private business, or individuals in conducting their lawful activities. Even the courts have been consistent on this.

"Keep it up, Brennan. Even Clapper's said that your rhetoric is becoming an issue. "

The mob doesn't like undue attention focused on it by the bad behavior of any of it's minions. When it happens, they usually get rid of the threat to their empire.

Don’t forget about healthcare for all, higher education for all, food and housing. Someone called Occasional Cortex told me so.

Does Brennan REALLY want to be under oath answering questions regarding his actions in the past 3 years or so?

There is no court that can countermand the authority of POTUS to exercise his duties as codified in Title 2 of the US Constitution.

All action within the executive branch is the prerogative of the Chief Executive.

That is only if judges follow the law. I expect Obama nominated judges to do exactly what the deep state wants, regardless of the law or the consequences.

This is actually hilarious. I wonder if the rest of the policy wonks with clearances realize that the *most* likely outcome for this is a policy that *automatically* strips swamp denizens of their security clearances after they quit, are fired, or retired.

And lots of them will realize that their value as consultants and media advisers will plummet without that after-job perk. And if they continue to consult, if it includes classified information, they will be breaking federal law.

Worst hit will be those denizens associated with just a single parties administrations.

There are tens of thousands of these people, and they will have Brennan to thank for the new “retirement tax” levied on them.

Brennan will lose. This whole thing may be a blessing in disguise by bringing to light the issue of forever clearances.

Clearances can be revoked for cause.

And the scumbags have all given plenty cause.

It matters not what the judges do.

What matters is what the executive does.

Some executives weaken their own presidency by heeding unlawful court activity.

Yep, our angry, cro-mangon former government welfare recipient is indeed expendable when it cones to the larger effort to control the US.
