A federal judge on Friday said the government must restart the entire DACA deportation amnesty, including accepting brand new applications but gave the administration a chance to appeal before his ruling takes effect.
The ruling by Judge John D. Bates is a major blow to President Trump, and creates even more confusion about his immigration policy.
Judge Bates said Mr. Trump and his Homeland Security Department do have the power to revoke the Obama-era DACA program, but they cut too many corners in the way they tried to do it.

So if I go rob a grocery store and steal all the food, because I think it is a good idea to pass out the food to “the hungry”, then the grocery store owner has to prove that this was not a good idea on my part, to help these hungry people, right?
Is this a fair analogy?
This just disgusts me that a judge is so uppity as to think he gets to make the law instead of upholding the law.
Support Free Republic, Folks!
Simply put;
The Judiciary just attempted to usurp the power of the Executive.
Pound sand, black robed muzzie.
Sadly, we have more walls (albeit temporary in most cases) going up around this president than we do the southern borders next to Mexico.
Ignore the stupid judge. Just ignore him.
I think President Trump should ignore this judges activism.
Bump!
Super President Judge Master Bates.
Judge Bates said Mr. Trump and his Homeland Security Department do have the power to revoke the Obama-era DACA program, but still failed to convince him.
WTF
Banana republic from the Bench.
DACA has no legal basis.
The Kenyanesian Usurper made it up out of thin air.
Bush League Republicans refused to sue to stop in 2012 when they could have killed it before it got started.
Bullseye!!
DACA was by presidential order. All presidential orders can be rescinded by the next president. That is the law and it is plain and simple.
I feel it is time for the president to defy the orders of Federal Courts and bring this immediately to the Supreme Court for clarifications.
Our lower Federal Courts have become activist courts outside of Constitutional Law. They must be held in check. The ninth court of appeals is the enemy of the people.
Absolutely no authority to command anything.
DACA had an expiration date.
DACA was illegal anyway.
See if this judge can find a military to enforce his fiat ruling.
Based on what legislation?! It is not the court’s role to write law. These are illegal aliens, an unconstitutional program started by Obama, and all that should be left to discuss—since congress did not pass any law giving these illegal aliens amnesty—is how they are deported.
I'm surprised that there is not an organized plan, a movement to end this tyranny once and for all. It seems to be "oh that's too bad (wink wink wink)". It's as though no one in any position of power cares.
And I'm surprised that the Trump administration doesn't fast track this to a higher court. Perhaps sometime next winter we will read that a higher court has voided this ruling. However that is part of the liberal plan—pile up enough obstructions to cause implementation of President Trump's policies to slow to a crawl.
There seems to be no one in the legislative branch who gives a damn to put a halt to this, even though their own powers are being usurped.
And President Trump should take a more aggressive proactive stance too. Bucking it to the Keebler Elf is an exercise in futility.
Okay, so what would be the high crime here?
Didn’t the USSC already settle this?!!!
EVERY time Congress took up DACA legislation, they rejected it. Trump and the Courts have ZERO option but to deport these illegal aliens. Send them home WITH THEIR ILLEGAL PARENTS AND FAMILIES.
Executive branch should answer, “ nope”.
Donald Trump owes it to the American people and the rule of law to specifically dismiss this judge’s asinine, incoherent, ruling.
They may have. But if they have, this judge has overruled the SCOTUS and reversed their order. It will have to go before the SCOTUS, now.
