Officer who shot Aurora homeowner involved in deadly shooting in June ( near Denver: update )

The Aurora police officer who shot and killed an armed homeowner early Monday morning was involved in another deadly shooting in late June.

The officer was returned to regular duty while the investigation of whether he was legally justified in using deadly force in the June incident was still ongoing.

In this week’s incident, police received multiple 911 calls just before 1:30 a.m. Monday reporting a disturbance. Aurora Police Chief Nick Metz, in a written release, said officers encountered “a very chaotic and violent scene,” heard gunfire inside a home at 10609 E. Montview Blvd. and then “encountered an armed adult male.”

An officer opened fire, hitting and killing the man, who has been identified as Richard "Gary" Black, a 73-year old Army veteran who served in Vietnam, earning a Bronze Star and a Purple Heart.

When police entered Black's home, they discovered a “deceased adult male intruder” inside.

According to the attorney representing Black’s family, the man never should have been shot by a police officer. He says an intruder broke into the Montview Boulevard home and grabbed Black’s 11-year-old grandson, who was sleeping on a couch, and dragged him to a bathroom, where he attacked him. Black and the boy’s father tried to pull the attacker off the child, but after a struggle Black grabbed his gun and shot and killed the man.

Moments later, the Aurora officer shot and killed Black.

Among those who called 911 was Jeanette Black, and she gave dispatchers a very specific description of her husband and what he was wearing. The family's attorney says evidence suggests that while Black was inside his home the officer who shot him was outside, although he said he wants to see body camera footage so he can better understand exactly what happened.

“My dad exited the bathroom, went around the corner, and I immediately heard multiple shots, which I thought was my dad engaging these other people in the house,” Hayashi said. “There was a pause, and then I hear people start screaming, ‘Police!’ and I hear people enter the house. And my son starts screaming, ‘I’m here with my dad. This crazy guy tried to attack me.’”

“They heard gunfire but they shot the first thing they saw moving, in my opinion, although all the officers’ spent cartridges were outside of the house. And judging by the line of fire, had they missed him, they could have shot me or my son through the wall.”

Could be a “trigger happy” cop

Two shooting incidents in a short amount of time. Of course they each have to be evaluated separately, but this department might have a loose cannon on their hands.

That was a mistake. Seems to me if an investigation is taking over a month, possibly coming up on two months, it isn't a slam-dunk. That means the shooting in June is probably questionable. Now he's involved in another highly questionable fatal shooting - this time of an innocent. (not sure about the first shooting - innocent/criminal)

It certainly sounds like a "bad shoot." Though the investigation - now investigations - will probably be intentionally dragged on for months so that public attention fades. Here's what will happen - I'd give this prediction a 90% to 95% probability of being correct:

Months from now, sometime early next year there will be an announcement that the investigations have determined the officer acted within department policy and training guidelines and no charges will be filed. This of course is an admission that in some/many/most jurisdictions if you have a badge you can literally get away with murder. It is an admission that department policy results in dead innocents - you know, those people they claim to protect and serve. How is it that it can be policy to occasionally kill one of them?

Dajon Harper, 26, was shot and killed by a 74-year-old Vietnam War veteran defending his home against the intruder who police say broke into the residence at 10609 East Montview Boulevard around 1:30 a.m.

The owner of the home, Richard “Gary” Black, Jr., was shot and killed by responding officers from the Aurora Police Department.

According to Black’s stepson, Chad Hayashi, a naked Harper had entered the home and for an unknown reason and began to violently attack his son. He told ABC News he was awoken in the middle of the night to find Harper choking the child and biting his ear in the bathtub.

Hayashi said Harper was shot and killed by Black amid a struggle after freeing the boy from the suspect’s grip.

The repeat criminal, intruder was naked and trying to drown the homeowner’s grandson in the bathtub.. the intruder had been attending a party at a home on the corner of North Iola Street and East Montview Boulevard before he ran across the five-lane road and onto the Black’s property.

Others from the party followed him onto the property and entered the house.

Stepson Chad Hayashi says officers ‘shot the first thing they saw moving’ : Hayashi was led from the house and was later told Black had ignored requests to drop his weapon. ( Lies by the police ?).

But “there was no warning at all” and “all the officer’s spent cartridges were outside the house. So, they shot through the open door ( that the criminal had knocked down to gain entrance to the house ) ,” Hayashi says, calling for the release of bodycam videos.

Per the Denver Channel, the man Black killed has been identified as 26-year-old Dajon Harper, who twice had charges of first-degree murder dropped or reduced.

More information needed. Could be a “trigger happy” cop or one with overpowering fear reflex. If either of those is true, he has the wrong temperament and shouldn’t be a cop.

Was it a "he"? I don't notice any details about the officer.

TheDenverChannel (ABC7) has an update about the autopsy of Richard Black. He was not wearing his hearing aids at the time of the shooting, so presumably he could not hear the officers (outside the house) spoken instructions.

After having two gunshots go off in close proximity, plus the other assorted shouting in the house (remember, the intruder's Mom and other family members were in the house), I am not sure if anyone could have heard shouted instructions, from outside the house. The ears shut down for several seconds after an extremely loud sound.
