Who May Qualify for H-2B Classification?
To qualify for H-2B nonimmigrant classification, the petitioner must establish that:
There are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work.
Employing H-2B workers will not adversely affect the wages and working conditions of similarly employed U.S. workers.
Its need for the prospective worker’s services or labor is temporary, regardless of whether the underlying job can be described as temporary.  The employer’s need is considered temporary if it is a(n):
One-time occurrence – A petitioner claiming a one-time occurrence must show that it has:
An employment situation that is otherwise permanent, but a temporary event of short duration has created the need for a temporary worker.
Not employed workers to perform the service or labor in the past, and will not need workers to perform the services or labor in the future;
                                     OR
Seasonal need – A petitioner claiming a seasonal need must show that the service or labor for which it seeks workers is:
Traditionally tied to a season of the year by an event or pattern; and
Of a recurring nature.
Note: You cannot claim a seasonal need if the time period when you do NOT need the service or labor is:
Unpredictable;
Subject to change; or
Considered a vacation period for your permanent employees.
                                   OR
Peakload need – A petitioner claiming a peakload need must show that it:
Regularly employs permanent workers to perform the services or labor at the place of employment;
Needs to temporarily supplement its permanent staff at the place of employment due to a seasonal or short-term demand; and
The temporary additions to staff will not become part of the employer’s regular operation.
                                 OR
Intermittent need – A petitioner claiming an intermittent need must show that it:
Has not employed permanent or full-time workers to perform the services or labor; and
Occasionally or intermittently needs temporary workers to perform services or labor for short periods.
H-2B petitioners must also provide a single valid temporary labor certification from the U.S. Department of Labor (DOL), or, if the workers will be employed on Guam, from the Guam Department of Labor (Guam DOL

Lay off criticizing Trump when you have no clue what the classification is, how it works, or what it means! BYE

Re: “I see you have never done the hiring in Florida....”

LOL!

I worked for 30 years in my family's business...

A hotel.

Two blocks off the beach.

A 30 minute drive from Mar-a-Lago.

So why do you think he resigned? And do you think his staffer was lying? The situation with the condo has pretty much been confirmed by him.

And the press didn’t make up the stories about his fishing for revenue for his wife.

The guy was weirdly just a diva and made it difficult for Trump while making it impossible for himself.

Can’t prove it by how you do not understand the process for H-2B hiring, in the info I gave you! Seriously? I doubt you did the hiring, or you would have known that!

Trump has explained this ad nauseum. He can’t get local workers. His jobs are temporary just for the season which is only several months.

My son and DIL were at a harbor side bar in Maine a few weeks ago and overheard the staff talking about going to the airport to pick up some workers from Eastern Europe.

Son asked why they were hiring outside help and response was “no one around here wants to work”.

Re: “Lay off criticizing Trump when you have no clue what the classification is, how it works, or what it means!”

You have hit the LOL jackpot this evening, Ambrosia.

Legal immigration and work visas have been my number one issue at Free Republic since we crushed the Bush-McCain Amnesty in 2005-2006.

I am certain there are people at Free Republic who know more about work visas than I do.

I am also certain that you are not one of them.

You forgot to mention the most important requirement of all for H-2B visas...

The employer must set the wage scale so low that it is IMPOSSIBLE to fill all the positions with American workers.

Trump is paying $12.68.

If Trump paid $18.00, he would have more qualified American applicants than he knows what do with.

As I stated before, if Trump cannot afford to hire Americans, then he needs to develop a new business plan.

Trump isn’t the problem, it’s blowhards like you, who are the real problem in America! Join the Dems, you fit right in! Oh, you are a RINO...same thing!

I don’t like it at all

Plenty of unemployed in PBC of all stripes that would appreciate the opportunity and training and chance to work at a classy place for the summer.

Sure it’s easier to bring in a bunch of trained servants from Eastern Europe, but the guy is President now.

Trump was required to step away from his businesses, but is still politically held liable for their acts.

Catch-22.

It appears that zeestephen has no idea how servers get paid.... it is hourly plus tips! Not a straight hourly rate. Also, busboys get tips from servers. As for maids etc that is hourly rate, and some get tips in room. If you look at the rates per links posted, it appears his $12 + rated from Trump are twice as much as anyone else, sounds good to me! A lot of BS going on here to criticize Trump, maybe this guy is a troll!

Re: “So why do you think he resigned?”

He was fired, according to WaPo and Bloomberg.

Re: “And do you think his staffer was lying?”

I have read that two staffers reported misconduct by Pruitt.

My first question - were the staffers career EPA employees? Pruitt sued the EPA 14 times as Oklahoma A.G. Hundreds of EPA employees petitioned the Senate to reject Pruitt.

My second question - if the staffers knew that Pruitt's requests or actions were misconduct, why did they not tell Pruitt?

Re: “The condo”

Pruitt was paying $50 a night ($1525 a month) to rent a bedroom and a bathroom. Those numbers are completely in line with craigslist. What did the previous tenants pay?

Re: “Wife”

The only thing I read is that a phone call was made to Chick-fil-A about buying a franchise. Since Chick-fil-A is a proudly Christian corporation, and since Pruitt and his wife are proudly Christian, this does not seem like a serious problem to me.

Bottom Line...

When Pruitt graduated from law school, he started a solo practice called “Christian Legal Services.”

He served 8 years in the State Senate.

He served 6 years as Oklahoma A.G.

He served 2 years as chairman of the Republican Attorneys General Association.

Then - he moved to Washington D.C.

Suddenly, after seventeen months - at age 50! - he is being investigated for 14 unethical or criminal actions.

Pruitt's net worth is $400,000 - most of it in his house.

It would cost millions of dollars to put on a serious defense against these charges.

The Political Left has decided to destroy Pruitt, in every way they can.

And Trump has decided to let them do it.

Re: “It appears that zeestephen has no idea how servers get paid.... it is hourly plus tips!”

It appears that Ambrosia has no idea that Mar-a-Lago is a private club that costs $200,000 to join, plus $14,000 a year to maintain a membership.

No tipping allowed.

Please refer to the “Additional Wage Information” box on Trump's application form for 40 H-2Bs. The word “Tips” does not appear anywhere.

Right—he was forced to resign, by POTUS. For cause. Largely stupid petty corruption things cause, but for cause.

And having full-time access to a condo you use part-time, but only paying for the nights you actually stay there—when it comes from someone with business before the EPA is corrupt. He wasn’t outright renting it by the month.

"Trump is paying $12.68" Minimum wage in Florida is $8.25 so Trump is paying way above that and still cannot fill the jobs. Not because of the wage but because most people are looking for permanent positions not just for several months. The pay scale isn't the problem so your argument is invalid. These are temporary jobs. I know you desperately want to believe people are flocking to these jobs but they arent.😀 People do flock to work at Wendy's for $8.25 per hour because it's a permanent position.

Even though no tipping is allowed, Trump is paying over 12.00+ per hour per your claim. So, and isn’t their choice if they want to work there. Besides $5 hr with tips at other places means Trump;s got it covered.... I really do NOT understand why you are so anti-Trump and on FR...What he pays is none of your bizwax!

Re: “He wasn’t outright renting it by the month.”

Correct.

He flew home many weekends, and traveled many week days.

My understanding is that Pruitt used the condo like a hotel room.

Once again, check out craigslist, for Washington D.C.

Most bedroom rentals are LESS than $1,525 a month, and even lower than that in the suburbs.

I still don't understand your confidence in MSM news reports about Pruitt.

When Manafort and Cohen flip, are you going to support impeachment because Mueller and the MSM claim Trump is a crook?

I'm not.

Re: “Notice he is now gone from the thread because he has no valid argument.”

Wishful thinking, ladies.

On the issues of legal immigration and work visas, I am a tireless debater.

Trump criticizes American companies for outsourcing their manufacturing to cheap foreign labor.

Then, Trump turns around and in-sources foreign labor to work at Mar-a-Lago, because they are willing to accept lower wages than home grown Americans.

That is shameful hypocrisy, and it harms the American economy.

I voted for Trump in 2016, and I will vote to reelect Trump in 2020, but only because he is the most conservative candidate who has a chance to win the election.

Bottom Line...

If Conservatives don't hold Trump's feet to the fire on basic Conservative issues, who will?
