Can Dems Block Trump’s Supreme Court Nominee?

The short answer: No

WASHINGTON (ChurchMilitant.com) - With Supreme Court Justice Anthony Kennedy's momentous announcement Wednesday that he'd be retiring, the focus now turns to the fight over the new Court vacancy.

Democrats won't have the leverage they've had in the past, as Republicans exercised the "nuclear option" in last year's battle to seat Justice Neil Gorsuch. After heated confirmation hearings, Democrats filibustered the vote, and Republicans made good on their promise to change Senate rules, voting to ensure cloture (the vote to end the filibuster) no longer requires a supermajority.

"This will be the first and last partisan filibuster of a Supreme Court nomination," Senate Majority Leader Mitch McConnell vowed at the time.

The change in Supreme Court rules will guarantee that Democrats can't block Trump's nominee to replace Kennedy via filibuster. But the nominee is not a shoo-in; with a handful of unreliable Republicans in the Senate, Trump's candidate — whoever it might be — is not guaranteed enough votes for confirmation.

Senators to Watch

Senator John McCain (AZ) has been absent all year owing to health reasons, and there is a good possibility he may sit out the confirmation vote, making the balance effectively 50 Republicans to 49 Democrats.

And defection by pro-abortion Republican Senators Susan Collins (ME) and Lisa Murkowski (AK) is a real possibility, especially if Trump comes through on his promise to nominate a solidly pro-life judge.

Senator Jeff Flake (AZ) has been no fan of Trump and has even threatened to block any judicial nominees, while Sen. Dean Heller (NV) is facing a difficult midterm race in a state that overwhelmingly went for Hillary Clinton, and will feel pressure to vote against Trump's pick.

But Democrat defectors could save Trump's nominee, particularly those running in close races in red states...

Thanks to Reid, dems can’t do it with any rules/laws. But, they may be able to incite a few nuts like the guy who shot up the republican baseball practice and almost killed Scalise.

They have said “any and all means necessary”. While Schumer may publicly criticize Maxine, I’d bet that privately they are considering “any and all means” they can use to stop Trump until 2020 - inciting violence is certainly on the table. Dem reactions to BLM, antifa, violence at Trump rallies, Ferguson, Baltimore, etc tells me they think violence IS appropriate in many cases.

Stopping a supreme court nominee is their top issue for the next few years. If violence was appropriate at Ferguson and killing 5 Dallas officers wasn’t going too far given the situation blacks face they certainly would consider it appropriate to use violence on senators and/or nominees. And if Trump gets a SC majority, the next time a Dem president is in power it would be appropriate to give him/her a few appointments to “correct” the court.

Some on MSNBC are admitting that.

Dems wanted to demoralize GOP voters with :Trump hasnt kept his promises.

This is more likely to energize GOP voters then Democrat voters, (as long as the nominee makes it through)

Many were not thrilled with Trump but bought the argument that they had to vote for Trump over the SC.

They’ve been engaging in a coup d’etat, have raided American citizen’s offices and homes on a hunting expedition without warrants based on any crime, they’ve disregarded the Constitution, have bankrupted people on a joyful quest for revenge on a sitting president, have called for violence against Trump supporters, have called for impeachment of a duly elected president a day or two after inauguration, worked hand-in-hand with the “mainstream press” to destroy and hamstring a duly-elected administration..........

and now they’ll find a way to block, destroy, discourage and eliminate any and all nominations that are made.

(Revolutionary scu#bags will always be revolutionary scu#bags.)

Most likely reason McCain hasn’t resigned already is to avoid Gov. Ducey having to name a replacement before Ducey faces a primary challenger August 28. Only reason for Ducey to be embarrassed by his Senate pick is if it’s Cindy McCain.

You know I’m not bagging on you.

People said that when women were in charge that the world would be such a peaceful place. I bought that crap in the 70’s.

For me, the most difficult thing is trying to understand how someone with the power to create a human being can then orchestrate one of the most massive child trafficking, and if the evidence is to be believed PEDOVORIA rings ever.

How can you raise a child and then treat children like cattle. Even cattle, however, are more humanely slaughtered. When the slaughter children, they increase the fear level to boost the amount of adrenaline in their bloodstreams - THEN they kill them.

I think we’ll find the father of lies is female. I can’t get my head around it.

Splendid analogy. Plus, if it was so important, the planned parenthood crowd would chip in and arrange transportation. Las Vegas has scores of flights from the lower 48 which can be had for around $100 each way.

They are less worried about keeping it legal than keeping it as the most convenient default option.

Even pre Roe, there were rape and medical exceptions everywhere. Today, even with a reversal, things would not change in all red states and many blue states.

Any nominee 45 specs is going to say the same thing, and be able to mean it - I believe in stare decisis.

Everybody forgets that to overturn law, you need standing - a case that challenges that law.

No SCOTUS can just decide, “Roe has gone on long enough.”

You can hunt for a case like that I guess, but you have to get the others to go along with you.

This is why women shouldn't be on the bench...they have a built-in pro-abortion trigger.

Do they realize that there are millions of women....including during centuries past, that are against abortion. That abortion can only be construed as murder.

With every inch of power the D's have they are using it to thwart Potus's judge appointments. But we have Mitch, I know some have problems with him, but he has gotten 21 Appellate judges appointed to the courts, and 20+ more waiting in the wings, waiting out the 30 hour clock. Appellate Judges are the most important next to the Supreme Court.

I heard him say, "the most important action the R Senate can take and I am taking it, is to get as many judges appointed to the appellate courts as we can, to have a lasting impact for generations to come."
