Audio taken during a Democratic National Committee (DNC) Rules Committee conference call reveals the immediate reaction to the news Wednesday of Supreme Court Justice Anthony Kennedy’s retirement.
In the audio clip shared on Twitter by Politico reporter David Siders, Democrats on the call express disappointment that Kennedy, a moderate conservative justice known for often being a swing vote, would be retiring.
After one participant reads the news aloud, cries of “oh,” and “oh my god” can be heard. The audio was taken during a public conference call on superdelegate reform.
“This is not good news,” one person says.
Another attendee points to Kennedy’s status as the court’s swing vote, but pointed out that he sided with the conservative majority in several recent rulings, including the decision to uphold President Trump’s travel ban.
“Not that he’s done us any good on these recent decisions, but he was the one that was usually persuadable,” the attendee says in the clip.
Kennedy’s departure opens the door for Trump to make his second Supreme Court nomination. Democrats have already expressed concern that whoever Trump appoints will swing the court farther to the right, and clear a path for anti-abortion advocates and other conservative movements to bring more cases.

It is going to be difficult. I fear Trump may have to nominate a moderate like Kennedy to secure the confirmation. My first choice has always been Janice Rogers Brown, but learned today she is herself retiring.

He or she will be the latest worst threat to all of our liberty since the founding of our republic. He or she will be the cause of the day for the angry left.

Rush was pointing out today that in these 5 to 4 decisions, the Leftists on the bench don’t look to the Constitution at all. They go for touchy feelie whims.
If we’re lucky, Trump will get to replace a few of those four.
When we have close to a 9 person SCOTUS that all keep the U. S. Constitution in mind, we’re out of the woods.

As for the next Supreme Court Justice, I believe Donald Trump should nominate a Conservative Black woman with impeccable credentials and a friendly personality that would win the hearts and minds of Democrats everywhere in and out of Congress during her confirmation hearings.
Any Democrat in Congress voting against her could be accused of racism or hating women — the two cardinal sins of the Democrats.
In addition, nominating a Black Woman to our highest court would help educate Black voters, especially women, that Republicans value people on the basis of their character not the color of their skin, and that it’s time for them to join Kanye West in escaping the Democrats’ plantation no matter how fiercely the bloodhounds of the liberal media might try to attack them.
What does she do now: (1)vote to confirm and hope and pray that helps her keep “her seat,” or (2) stick with Schumer and attempt to stop a Supreme, while giving up “her seat?”
She gets no third option other than retire now and allow MO’s Republican Governor select her replacement!
Poor gal, she was thinking she just might skate by with another squeaker election. Now, it so much.

McCain is so close to meeting his maker there is absolutely no way he can withstand a trip to DC and show up on the Senate floor to vote. He is out of this.
If he does show up and is ambulatory we can rest assured his brain tumor was a scam for something else.

well, we here certainly did, because back when this place was filled with “conservative” purists who thought Trump was too crude and not “conservative” enough, all anyone here had to point out was the already vacant SCOTUS seat and 2-3 more coming up during the next 8 years ...
