D’Souza’s claim of selective prosecution received support from some conservative media and commentators.[130] Aside from those, Harvard law professor Alan Dershowitz felt that the prosecution was unfair: “The idea of charging him with a felony for this doesn’t sound like a proper exercise of prosecutorial discretion.... I can’t help but think that [D’Souza’s] politics have something to do with it.... It smacks of selective prosecution.” He went on to say such alleged campaign violations are common in politics.[131] In May, United States District Judge Richard M. Berman rejected that contention, stating, “The court concludes the defendant has respectfully submitted no evidence he was selectively prosecuted.”[132]
On May 31, 2018, President Donald Trump granted D’Souza a full pardon, claiming on Twitter that the author/activist “was treated very unfairly by our government.”[18]
