What’s the upshot here? That he would need Consent of the Senate to obtain such status?
I believe Levin is talking directly to TSEliot, a Reagan appointee, and giving him the ammo over the air to toss the Mueller prosecution out the front door of his court room. The judge has already questioned the legitimacy of their sad case. If he acts correctly it will set precedent for all other cases, Mueller will be dead in the water.
THIS, and other Levins positions on this mess is why Trump should fire Sessions and appoint Levin as AG. Levin is smart and tough. Enough with all the legal tip-toeing and pearl clutching thats been going on the last 18 months.

Levin raises good points that would apply if this investigation was pursuing a democrat president. In the current circumstance, I’m surprised the learned Levin forgot that the Constitution doesn’t apply to Mueller.
Much ado about nothing - at least nothing that anyone will do anything about.
Special Counsels are supposed to be vetted for conflicts of interest. Didn’t happen.
Special Counsels are supposed to be appointed to investigate a CRIME. So what CRIME is Mueller investigating?

Cannot Trump shut down Mueller and his ilk at anytime?
Yes, he “could,” but his advisors have him convinced that it would be political suicide to do so.
Thinking that none of Mueller’s witch hunt should be paid by taxpayers. That should all be on his dime or on those who put him up to this,but not the taxpayers.
. . . which would seem to raise the question of whether there is such a thing as an amicus brief which Levin himself could file with the court.
I think it's deeper than that.
Given that Mueller is acting as a "principle officer," Rosenstein doesn't have the Constitutional authority to appoint principle officers, only the President does.
Therefore, the matter doesn't even get to the Senate (which would be highly likely to confirm) if the President declines to appoint Mueller in the first place.

My guess he plans to let the chips fall and when Mueller is gone, Trump will dump Sessions like a hot potato.
Since Mueller is apparently freelancing with no oversight, he fails the "inferior officer" test. Therefore, he must be appointed by the President before he can be confirmed by the Senate.
The alternative is for the AG to rein in Mueller and narrow the scope of his investigation to the Russian collusion theory only (which still isn't a crime), thereby relegating him to "inferior officer" status.
