Exclusive: Nunes demands Justice Department records. Then he doesn't read them

CNN)House Intelligence Chairman Devin Nunes was livid.

For months, he had been demanding a fully uncensored version of a highly sensitive document from the Justice Department explaining how the Russia investigation began in 2016, but he wasn't getting it. As the standoff escalated, Nunes began warning Deputy Attorney General Rod Rosenstein -- the man in charge of special counsel Robert Mueller's Russia investigation -- that he could face contempt of Congress, or even worse. "We're not going to just hold in contempt," Nunes said to Fox News last month. "We will have a plan to hold in contempt and to impeach." Nunes had already been offered time to review a copy of the electronic communication formally authorizing the FBI's investigation into Russian interference in the 2016 election, but he had publicly demanded to see what was behind certain blacked out lines.

Clearly as well, this article is a sign of desperation on CNN’s part. After Stephanopoulos’ leading questions of Comey and Tapper desperately trying to validate his erroneous co-authored 1/10/2017 article with Bernstein based on Clapper’s leak...

...the train is coming off the tracks.

We don’t know what they “redacted” and what was left untouched. The CNN characters should not know either. I suppose Mueller would say he doesn’t want the whole memo disclosed because he doesn’t want to show his cards before the inquisitions begin. Or maybe he doesn’t want us to know the whole thing was based on the payed-for-by-Hillary “dossier” and some anti-Trump speculation.

Nunes should not have to go to the DOJ to view something that has most of it redacted. Congress has over sight of the FBI, DOJ, in fact they created these two depts. Congress is entitled to these document with no redaction delivered to congress as part of their oversight. The FBI DOJ seem to think they are separate dept not responsible to anyone. They are also under the administration and the Pres. under article II has complete control of the FBI and DOJ and can fire anyone anytime. The pres can also order them to release all docs to congress which he should do ASAP.

Fake News. Nunes did re the 1-1/2 page document he asked for. What he wants to know is what was redacted. Also, he found no basis for a FISA warrant, if I heard him correctly.

If its from CNN, consider it just as reliable as Russian press releases. In fact, I’ve found some Soviet documents to be more honest during the Cold War than CNN has ever been.

It’s really a disgrace that I would trust the commies over CNN but it looks like that is the situation.

Not necessarily. The scope of congressional oversight is not without limitations.

Congress has oversight regarding methods and practices of the executive branch, but that role does not necessarily extend to the details of an ongoing case when after-the-fact review will suffice.

Congressional committees are bi-partisan and leaks of classified information are virtually impossible to prevent, especially when the case is politicized. For this reason, heavy redactions are allowed and commonplace.

When the case is closed, congressional oversight committees can receive unredacted material after the fact, and still fulfill their oversight responsibility of executive branch methods and practices, without jeopardizing or micromanaging an open case.

This is similar to the board of directors’ audit committee role in a private corporation. They select the CPA firm which conducts an annual audit and reports findings to the committee, but the audit is a review of the fiscal year just completed. The board decides policies and procedures but does not interfere with current operations.

There is always a lot of posturing and grandstanding and public statements and demands from congressional oversight committee members - because they are always getting pressured by lobbyists and constituents to “do something”.

Rather than publicly admit they have limitted authority over the executive branch, they often choose to stamp their feet, act indignant and make threats.

Limited after-the-fact congressional oversight of executive branch methods and practices makes sense, but congress can’t “oversee” open cases without violating the constitution’s separation of powers doctrine.
