Deepest blow yet to Trump’s phaseout

....Judge John D. Bates’s ruling would require a full restart, meaning even illegal immigrant “Dreamers” who’d never been approved before would now be able to apply for DACA.... judge imposed a 90-day delay on his own ruling to give the government a chance to reargue its case, but for now the ruling stands as the most severe blow yet to Mr. Trump’s phaseout.

Judge Bates said the government’s reasoning for revoking DACA wasn’t convincing enough, and so it amounted to an “arbitrary and capricious” decision, which makes it illegal under the Administrative Procedures Act.

“The Department’s decision to rescind DACA was predicated primarily on its legal judgment that the program was unlawful.

Why does the judge think that the Administrative Procedures Act overrules an EO by the President?

Where is the constitutional basis for this decision? THERE IS NONE! Unconstitutional federal court decisions must be IGNORED AND REJECTED and President Trump must continue his efforts to stop invasion (the immigration of illegals and enemies) as mandated by the Constitution (U.S. Const., Art. IV, Sec. 4).

DACA Was illegal in the first place, and no judge can tell a President to violate the law. Trump should have the idiot arrested.

Am I wrong in summarizing that DACA was an executive order that the courts allowed, but the same courts are now not allowing an executive order to repeal DACA?

Are executive orders only “legal and binding” when the judges agree with the POTUS who issued them?

So an Executive Order which started DACA is rescinded by an Executive Order which is then blocked by a Judicial appointee.

Let’s relax. 90 days for govt to respond and then up to Supreme Court and hopefully someone dies on the left of natural causes on the SCOTUS

We won the election. Trump is doing a lot of good.

There’s no tipping point right now.

85 percent of the people accept Trump as their president, which is in line with every other president’s numbers.

I DO AGREE we are at a tipping point with figuring out how to take such power away from judges.

This is a serious question - How do you figure you don’t need any Democrat votes to declare DACA illegal. Last time I checked, it takes 60 votes to get a law through the Senate (I know it is a rule, but the Constitution says that the Senate can make up its own procedural rules).
