Actually, if you're using the First Amendment then it should absolutely stand: for the First Amendment acts specifically and explicitly on something called congress, and the State of California has no such entity. What should be used is instead California's own Constitution —

ARTICLE I, SEC. 4.

Free exercise and enjoyment of religion without discrimination or preference are guaranteed. This liberty of conscience does not excuse acts that are licentious or inconsistent with the peace or safety of the State. The Legislature shall make no law respecting an establishment of religion.

A person is not incompetent to be a witness or juror because of his or her opinions on religious beliefs.



ARTICLE I, SEC. 2.

(a) Every person may freely speak, write and publish his or her sentiments on all subjects, being responsible for the abuse of this right. A law may not restrain or abridge liberty of speech or press.

Thank you for referencing that article detective. As usual, please note that the following critique is directed at the article and not at you.

Are patriots who value your religious expression and free speech aware that the 14th Amendment protects you from state actors who abridge your constitutionally enumerated protections regardless if you are minority voters?

Patriots also need to know that knowing your 14th Amendment protections isn’t enough.

More specifically, we’re still stuck with a corrupt, post-17th Amendment (17A) ratification Congress left over from the lawless Obama Administration that will predictably not lift a finger to exercise its 14A powers to make punitive laws to discourage state actors from abridging constitutionally enumerated protections..

The remedy …

Patriots need to finish the job that they started when they elected Trump president.

More specifically, patriots now need to be making sure that there are plenty of Trump-supporting patriot candidates on the 2018 primary ballots, candidates who will be willing to make punitive laws to discourage abridgment of constitutionally enumerated rights by state actors.

Patriots must then pink-slip career lawmakers by sending patriot candidate lawmakers to DC on election day so that they can start making such laws.

And until the states wake up and repeal 17A, as evidenced by concerns about the integrity of the outcome of Alabama's and Pennsylvania's special elections, patriot candidates need to win elections by a large enough margin to compensate for possible deep state ballot box fraud, associated MSM scare tactics, and interference from people like Soros.

If you believe that the 14th amendment was legitimately adopted, and that the federal courts have interpreted it (the 14th) accurately, then what you are saying is not the current “law.”

Federal courts have ruled that states can not deny to any person within its jurisdiction “the equal protection of the laws”. Thus, not only can Congress not infringe on the 1st amendment, state government can't either.

I think they hope to get around 1st amendment because the bill doesn’t ban the material out right but just the sale of the material.

As crazy as Governor Moonbeam is he has veto stuff like this in the past.

We used to do a lot of business in CA but started limiting our exposure there about 5 years ago. We don’t do any business anywhere on the coast anymore...just forestry and agriculture in NorCal and the Central Valley. The coastal areas have a lot of money but are ethically bankrupt.

CA passed new legislation for professional licensing which was a pain to get. Now that we have our license, we don’t dare let it lapse. I completed our “Annual Report” last month...74 pages and two days of irrelevant busy work which I’m confident nobody even looks at. They just want us to file and pay the annual filing fee.

I hear you, but consider the following:

For quite a while ‘the courts’ have cared more about being activist social justice warriors rather than respect the Constitution, the true law of the land. This includes the Supreme Court.

You may be right about this basically being the straw that breaks the camel’s back, but there have been plenty of reasons for that to happen and so far it’s business as usual.
