London (AFP) - Harvey Weinstein's lawyer said Saturday a woman having sex with a Hollywood producer to advance her career is "not rape", in a British newspaper interview on the eve of the Oscars.
Ben Brafman is one of the US' top criminal defence attorneys, hired by the disgraced Hollywood mogul whose career is in tatters following accusations of sexual harassment, assault and rape.
More than 100 women have accused Weinstein of impropriety going back 40 years, but Brafman argued there was no criminal behaviour.

Just get Gandalf to come testify
He admitted that directors would get resumes from actresses wanting a part in a movie that were clearly marked “DRR” - meaning “Directors Rights Respected” - code worlds for “yes I’ll have sex with you for a part”
Unless you're an abortion supporting Democrat named Bill Clinton.
Is Harvey Weinstein a douchebag? Sure.
Is what he did illegal? Not looking like it. Any one of these women could've said "NO!" and gone back home.
Instead they chose to use their bodies and their sexuality to get ahead in their careers. That was their choice.
They also made the choice to subject other women to the same boorish behavior that they "suffered" in order to advance their careers when they should've said "NO!" and come forward at the time.
The tables are going to flip on these women - it's already started.
FINALLY we’re having this important conversation. Time to take thew #MeToo hypocrites down
I have read that the NY AG is thinking of prosecuting Weinstein. I wonder if he will choose to prosecute Spacey? Or is gay molestation too PC to touch? (So to speak) And who was it that said weve already established what you are....we are now just determining the price?
Errol Flynn was notorious. I am reading his autobio. I imagine he may be portraying himself in a favorable light.
I agree. At first it looked like the whole #MeToo movement was about these “poor hollywood actresses” being victims and as time has gone on they look far less like victims and more and more like extortionist prostitutes.
Women have willingly given sex and pretend-love in return for an acting career. Everybody knows this. Suddenly it’s horrible, and the guy gets his a$$ roasted. Sorry, matey, but it takes two to do the horizontal lambada, and the woman is 100% as responsible for the action as the man. A quid pro quo. No different from prostitution.
It’s not rape, but certainly using sex as a condition of advancement is most definitely not legal under currently applicable US law.
But I think this falls into the category of Hollywood wants to wag their finger at middle America and hector us about how awful we are to women, while in reality, they are doing stuff (daily, systematically) that the rest of us would never even dream of.
Great point.
If there is persuasion involved, when does that morph into coercion?
If there is coercion involved, when does that morph into rape?
I don’t think we can dismiss the rape stuff this easily.
And his lawyer is trying to equate the women who were sexually assaulted with the women who consented. Judging by some of the responses here, it’s working.
Bingo
I think it helps explain the egos and Teflon coatings of people like FatHarv. They were getting it so often and easily that they thought the worse anyone could do is “just say no”
The irony is I bet most of the #MeToo types put out to get “a head” Pun totally intended
You know Streep and countless others had no problems spreading for no-matter-how-gross types, esp “God” Weinstein
As cultural genius whoopie goldberg said: Is it rape rape?
That con artist will play politics. Get the mad as hell women all worked up by prosecuting FatHarv.
But leave the homosexual guy alone.
The women are private contractors not employees. Once hired, it crosses the line.
Correct, if a woman (or a man (I know, eww... but it happens)) offers themselves to advance their career, that is immoral, but not illegal.
However, what Mr. Weinstien is accused of is stating or implying that unless certain actresses provided him sexual gratification, he would ruin or undermine their career. That is blackmail and sexual assault, an entirely different matter. I hope they can gather enough proof of that to convict and imprison him.
The guy is a sleaze, but that’s all they got on him.
There is a rather wealthy Suburb not far from where I live. Every single time I’ve ventured into that place I see young, fit, attractive women driving brand new beautiful cars, wearing expensive clothes, living in huge beautiful homes. Every single one of these young ladies is married to a fat, balding, slimy old fart twenty to thirty years her senior. What’s the difference?
That’s really the point. The women don’t believe they’re part of the problem. There’s those that will engage and others that won’t - for those that won’t it is workplace sexual harassment, one perpetuated by other women.
If none of the women indulged in this practice then the men wouldn’t try, at minimum it would be reduced and not part of the business culture.
Many of the “#MeToo” standups only consider themselves a victim, not part of the problem. They’re all part of the same cesspit, the pathetic virtue signalling makes me want to vomit. Yes, there are some true victims, those forcibly raped or had to lose work due to not conforming. I’d bet many of those claiming to be victims are only victim to a culture they encouraged - that others will have to endure.
