The Obama administration was notable for its disregard of the rule of law in its avid pursuit of politically desirable outcomes. Law professor David Bernsteins book on that subject, Lawless examined many such instances (see my review here) including the demand by Department of Education officials that colleges and universities scrap due process for accused male students in pursuit of high numbers of punishments for sexual assault.
Now some of the schools that eagerly complied with the Departments abuse of Title IX (the 1972 law that was written to keep schools that received federal funds from discriminating against women applicants) are feeling strong repercussions, as students use our justice system to right the wrongs done to them.
James Madison University (JMU) is a public university in Virginias Shenandoah Valley. Its probably not a school you would expect rampaging ideology to cause a protracted legal battle, but thats what happened.
The case is like many others a hookup between college students that ended in anger, with the woman using the Obama-era sexual assault rules for revenge. The man (John Doe) met the woman (Jane Roe) in August 2014 when both were incoming students at JMU. They had sex one night and exchanged friendly communications for days. The two hung out together and had sex again the following week.
One evening thereafter, Roe went to Does room carrying her pillow and blanket, but was shocked to find another woman sitting on Does bed. She left in a huff and a few days later filed charges against Doe for sexual misconduct. She claimed that at the time of their first encounter, she had been too intoxicated to consent to sex. Their hookup therefore amounted to rape and she wanted Doe punished.

AdBlock blocked. I will drop my AdBlocker for no one.
I applaud this and similar rulings but still want the cost to come out of the guilty administrators’ and professors’ pockets instead of the tax payers who fund the public universities. Refusing or ignoring the rule of law should be a firing offense.
Same here.
Them asking me to drop it is like asking me if it’s OK to abuse me.
Intoxicate "incoming student" generally means "under 21" and thus illegally consuming alcohol.
A woman would be held legally responsible for her bad decision if she drove a car while drunk. She should be considered equally responsible for any bad decisions she made in getting into bed with a guy while drunk.
Interesting... I’m running AdBlock version 3.25.3 as well as Ghostery (on Windows 7, Chrome browser) and was able to access the article.
then the psycho socialists will woke and sue the manufacturers to protect the robots from their owners and the government will step in and fix things...

So you think you deserve everything for free. The writers who work at Forbes don’t deserve to be paid.
Talk about an entitlement mentality.
How “John Doe vs. Washington and Lee University”, another case of Title IX abuse in the Shenandoah Valley, would have ended - if in saner times.
You can’t sign a contract when drunk.

Easiest ‘solution’ would be to stop the illegal welfare transfer of property by force of govt.
Concur on your assessment. Why AREN’T the admin/prof. held personally accountable, as well as the institution they represent?
House of cards, FRiend.
Regret is not rape.
Mine is 3.0.2 and I see no way to upgrade. Thanks for this info.
Are you Ok? Havin a bad day?
Sure you can. But if you can prove you were drunk and the other party knew it, the contract is unenforceable. I'm not sure about what happens if the other party didn't know; I'm not a lawyer and didn't stay at one of those fancy hotels last night.
But you can gamble away thousands of dollars while drunk, or spend thousands in a strip bar, and forget about getting a refund.
Snowflakes need to understand that, if you don't want to make poor drunken decisions, then perhaps it would be wise to not drink to the point of making bad decisions.
I guess no one read the article, because that doesn’t seem to be what happened here.
Re: “Sex robots will fix this...”
I agree, and I also understand your Comment was a bit tongue in cheek.
Looking at the robot issue seriously, I think they will solve a multitude of criminal and legal issues in coming decades.
I come from five generations of small business owners.
Our number one family stress issue for the last five generations has been finding and retaining good employees.
The idea that we can hire robots in the near future - instead of human beings - gives me a sense of liberation I cannot describe!
