Try enforcing existing gun laws before launching new ones

Here we go again with yet another “national conversation” about guns that is neither a conversation nor national. And not productive.

Understandably, as with the Newtown, Conn., elementary school massacre in 2012, the agonized outcries and visceral fears after the outrageous Broward high school deaths on Feb. 14 erupt from parents who entrust their most prized treasures to a public school. The betrayal is horrendous. The suffering unimaginable. And we flail around trying to find answers for the unimaginable, the inexplicable, the unacceptable.

There must be something we can do to prevent such awful events. There is. We could have.

We’re certain to hear much more of the tiresome, trite arguments from all sides this week as the annual Conservative Political Action Conference meets near Washington. You know, Second Amendment, our blessed children, only government can do something, government has no place, yada yada.

No one needs a crystal ball to know what will come of all this: Nothing. Same as after previous incidents.

Remember a little more than five years ago to protect himself against political backlash, President Obama handed the molten gun-control debate to Vice President Joe Biden to honcho new restrictions through Congress so school shootings would never happen again? Nothing.

We could do what Israel’s been doing in large schools for decades after terrorists killed scores of children in an attack. Lock the doors. Train and arm a few unidentified teachers to conceal-carry.

Perhaps some new restrictions will be necessary. Recall after the even worse mass shooting in Las Vegas last fall even the National Rifle Association endorsed restrictions on the so-called bump stocks that turned his long guns into virtual automatic weapons. What happened after that “national conversation”?

Nothing, until just this week when the president ordered a ban.

Of the thousands prohibited from purchasing firearms who try to anyway, very few are prosecuted.
Those caught with illegal guns are likewise rarely prosecuted to the full extent of the law.

How’s this for a tough gun law. Illegally kill someone with a gun and earn a mandatory death sentence without appeal. Illegally kill more than 2 people in a school zone or public gathering place, same sentence for that person and his/her closest relative as well as the FBI (special) agent that knew the guy/gal was reported to the FBI and nothing done about it.

I’m concerned about all of the talk about “strengthening background checks.” It’s a background check. What’s not strong about it? I’ve seen several outlets espouse the idea of feeding mental health or even just general healthcare records into the NCIC system to allow them to alert on mental health issues. Problem is: who puts that information into the records?

At some point we’re going to see unelected bureaucrats, leftist doctors, and law enforcement personnel injecting their personal opinions into these records, and someone who is perfectly stable will be denied a purchase because they cut off a cop in traffic or refused to talk about guns in the home with a doctor. Where is the line? And why do we keep pushing it?

The second amendment is unalienable. It’s not something they can take away. If you’re adjudicated mentally unstable, it means that a court has decided you are unfit to own a weapon, and that should mean a trip to a state mental health institute, but then, we don’t have any of those anymore, do we? No, of course not. We just set those people free to walk the streets.

Mental health information should not be a direct non-judicial constraint. Instead, it should require a court review and order to get posted. I’d like to think a judge would review last week’s shooter and deem him unfit to possess guns. And, likewise, recognize that a veteran on PTSD medication with no violent history or intent, is not unfit. Just need some commonsense. Not perfect but we obviously need to do more and do so with some appropriate non-emotional due process so this doesn’t become an abused process to deny citizens their 2nd amendment rights.
