Homeland Security Secretary Kirstjen Nielsen confirmed Tuesday that her department has asked federal prosecutors to see if they can lodge criminal charges against sanctuary cities that refuse to cooperate with federal deportation efforts.
“The Department of Justice is reviewing what avenues may be available,” Ms. Nielsen told the Senate Judiciary Committee.
Her confirmation came after California’s new sanctuary law went into effect Jan. 1, severely restricting cooperation the state or any of its localities could offer.

The Supreme Court has ruled that the Federal Government may not require state and local governments to expend resources to enforce federal law, in Printz v. United States (1997), under the Tenth Amendment.

To be charged, the state officials have to be taking federal funds and not doing what is required for those funds or actively blocking federal efforts, instead of simply refusing to follow federal orders.
Use a page or pages from the rat book, withhold federal funding until the comply

In this case though it would not be expending resources to enforce Federal law, but expending resources to undermine it.
