I think he is referring to the selective prosecution of the federal drug laws regarding pot. The DOJ is kicking the issue back to Congress, since they are the ones who wrote the laws.

Notice Rosenstein used the word "rules" and not the word "laws". It's as if he doesn't want to imply that the DOJ broke "laws".
