Judge Tanya S. Chutkan of the US District Court for the District of Columbia required the department to give the American Civil Liberties Union access to the unnamed detainee to determine if he wants the advocacy group or a court-appointed attorney to challenge his detention.
Last month, the American Civil Liberties Union filed a lawsuit requesting that the man be given access to counsel and demanding that the Trump administration justify his continued detention without charges. The Justice Department says the ACLU has no standing to sue because the group has not proved that the individual wants it to sue on his behalf.
The individual, whose precise location has not been disclosed, surrendered to US-backed militia forces in Syria and was turned over to US forces in mid-September, according to court documents.

I thought you could be stripped of your citizenship if you fight for another country with the intent of overthrowing the US government.
I thought so too. But I also thought you had to be found guilty first.
Dunno.
Apparently this judge thinks he can exercise his rights as a citizen while fighting against having them removed.
Or something.
...hope he's strapped to the bottom of a Huey to cushion landings....
Not to my knowledge.
Long ago the Court ruled that leaving a traitor stateless was a cruel and unusual punishment ... maintaining that the death sentence is proper.
And it is.
this reminds me a bit of the John Walker Lindh case. Isn’t “Taliban John” still in prison? Did he lose his citizenship for fighting for the Taliban against us? I don’t recall the details of his case,
The U.S. military needs to tell this joke of a “judge” it has no jurisdiction and to politely pack sand where the sun don’ t shine. He gave up whatever rights he had when he took up arms against the U.S. military.
Turn this POS over to our “allies” and let them deal with him as they see fit.
The Judge is about what youd expect
And this is why you try to kill them all on th battle field!
John Doo Doo Linh Lennon Johnny Walker (names all attributed to him) is now an Irish citizen.
They can have him when he is released in 2019.

The Nazis made a big mistake in World War II.
Instead of fighting the U.S., all their soldiers should have surrendered, then claimed US citizenship and jammed up the court system. Some ACLU judge would then have freed them.
The judge is a black Obama appointee.
That she was appointed by Obama has some sig ificance.
In this case, the schmuck is entitled to legal representation.
He is still an American Citizen, for now.
Not for long. He's due to be released in two years. He applied and got Irish citizenship through his mother. The Irish can't be that hard up for citizens but they're more than welcome to him.
Convicted traitors should be shut.
This judge recused herself twice from Dossier cases - no reason given.
