Two attorneys are hopeful that the most liberal appellate court in the nation will become conservative. Judge Alex Kozinski of the 9th Circuit Court of Appeals announced his retirement Monday after women alleged he subjected them to inappropriate sexual conduct or comments.
"Good riddance that this judge is gone is retiring for this sexual harassment allegation," Liberty Counsel Founder and Chairman Mat Staver commented on Kozinskis retirement. "This is a very serious situation, and I think it's about time to get rid of a lot more judges not just for this, but for their judicial activism."
According to the Associated Press, Kozinski's retirement leaves five seats open on the 9th Circuit with two more judges already having announced their intention to retire next year. This gives President Donald Trump potentially seven seats to fill on the largest and most liberal appeals court in the country.
"This is good news," Staver continued. "That will reshape the future of the 9th Circuit Court of Appeals for the better. What we want are judges who respect the Constitution not activist judges who make it up as they go.
Pacific Justice Institute President Brad Dacus agrees with Stavers take on the situation.
"The problem is, it's only good news to the extent to which there is a president in the White House willing to appoint conservative justices, which so-far we see is exactly who we have in the White House, Dacus argued.

But then it won’t be the Ninth Circus anymore!
As I have had it explained to me, Judge Alex Kozinski of the 9th Circuit Court of Appeals is not a bad judge.
His activity was suspect and he had to step down.
Just because a court has mostly bad people, it doesn’t mean every judge is bad. The appointment to replace him, will likely be a neutral change.
I do hope Trump can appoint great judges and reverse this court’s leanings. It would be very helpful to California, struggling to get through this leftist onslaught.
If that truely happens, liberal heads will explode!!!!
McCain and Flake are sponsoring a Bill to break up the Ninth Circus and adding a new Judicial District. If that Bill makes it through then Trump will be able to load the new district as well.
The 9th Circuit of Appeals has 29 positions for active (I.e., not senior judges who can work part time) judges of which 5 are vacant. Its going to take a long time to turn it.
Obama must have appointed many judges and Clinton appointed judges who are probably ready to retire. Hope so.
I’ve said for a while that some of the circuits need to be divided. Then we can put even more judges on the bench.

I have seen that reported. I guess it gives President Trump to put someone in that is a solid Conservative.

Yeah, I'm sure Doug Jones, the new Democrat Senator from Alabama, will be glad to help Conservatives achieve that fantasy.
With McCain and Rand Paul away from the Senate because of health issues, and with the constant threat of RINO Senator defections, the Democrats can block any Judge they want to.
In fact, with the help of a couple RINOs, the Democrats can possibly get some of their own judicial choices confirmed!

Kozinski was reasonably Originalist, and definitely pro-Second Amendment. I’m NOT happy about losing him, though at least Trump will appoint his successor and not Felonia Milhous von Pantsuit.

President Trump. Do not lose sight of this chance. You could even transfer other conservative judges until such time as to get more judges appointed.
I read, some time back, that 82% of the 9th Circuit Court’s rulings were overturned.
He probably was a decent judge, but he is 67 years old. Time to go to pasture. We need him replaced with someone in their late 30’s.
