The Justice Department is considering bringing federal charges against Jose Ines Garcia Zarate after his not guilty verdict in the Kate Steinle murder trial, department officials told Fox News on Friday.

Why don’t they go after him as a persistent felony offender?
I believe he has been deported five times previously. Obviously that is only a minor inconvenience for him. It is a crime to return following deportation which has a penalty of, I believe, up to five years in federal prison with no parole. That is more severe than he would have faced for a manslauter conviction at the state level. If he were to be charged for each illegal re-entry, he could be facing up to twenty five years. No double jeopardy question involved. In addition, he would not be tried in San Francisco, but in the jurisdiction where he committed the illegal entry.
That would be my guess as well. His presence in the country, clearly shown by arrests would likely prove the case.
Option two would be a Federal civil rights case but that might be more work and I’m not sure the penalties would match the first option with five possible charges?

Worse. BLM and MS 13 are the testbeds to develop para military gangs whose purpose is ethnic cleansing of white people and those who ‘act white’.
In addition, it would be a powerful message to repeat offenders and their supporters if the book was thrown at this high profile thug in a very public demonstration of resolve. For too long, deportation has been nothing more than a paid trip home to visit friends and relatives followed by a quick return to pick up where they left off.
