Texas church shooter Devin Kelley court-martialed.. for domestic abuse {ExistingGunLawFailsAgain}

Devin Kelley, the man accused of killing 26 people in Texas Sunday, was court-martialed in 2012... the Air Force confirmed to the Daily News Sunday night.

In 2012, he was court-martialed after being accused of assaulting his spouse and child, spokeswoman Ann Stefanek said.

Kelley was confined for 12 months and was reduced to E-1 rank, airman basic, which is the lowest rank possible.

The Lautenberg Amendment has, since the Clinton "dual-presidency," prohibited those convicted of even a misdemeanor of domestic violence from having a gun.

YET AGAIN GUN CONTROL LAWS HAVE FAILED!

But that will not stop Democrat politicians and Democrat media for demanding more pointless laws that criminals and the criminally minded will also ignore.

Just a week ago, a muzzie killed 8 people in New York City by running them over with a pickup truck.

Where are all the liberals? Why aren’t they calling for a ban on pickup trucks?

Similar sorts of things have happened in the Great White North. In 1989, Gamil Gharbi (aka Marc Lepine) was given a Firearms Acquisition Certificate by a Montreal police department firearms officer who failed to do the proper background check on Gharbi, which likely would have revealed that he had been turned down by the Canadian Forces due to mental instability. As a result, he was able to legally purchase the Ruger Mini 14 sporting rifle he used in the December 1989 rampage at Ecole Polytechnique. But FACs, when introduced in 1979 for standard hunting rifles and shotgun purchases, were supposed to have kept such people from legally buying guns.

“The Texas church madman was a disgraced Air Force veteran who was court-marshaled in 2012 after assaulting his wife and child, reports said.

Devin Patrick Kelley, who joined the military in 2010,was given a dishonorable discharge and slapped with 12 months of confinement in 2014 after his court marshaling, CBS News reported.

The military said Sunday that Kelly served in Logistics Readiness at Holloman Air Force Base in New Mexico from 2010 until his discharge.

The Pentagon also confirmed that Kelley was an airman “at one point,” but did not provide additional details.

Kelly was married and lived in a wooded area on the rural, western outskirts of New Braunfels, north of San Antonio.

His mother-in-law has a post-office box in Sutherland Springs, where he launched his massacre, about 50 minutes away.”

I have no doubt of that. But without criminal penalties then businesses won't have an incentive to uphold the law.

Difficult to believe this animal did not leave some prior indications of what he planned. Any word on mental status? It looks quite a bit like Columbine (PROZAC ! !)

Big Pharma can probably keep that information out of the public eye. Prozac makes everything seem just fine. Shoot a few folks? Ahh, Why not?

I'll stay out of the legal weeds and loopholes but whether "fake news" or fake laws, we have another law that failed to do as the Democrats promised.

I did check for the military legal weeds and found the following excerpt from[Link] for FReepers' information, but it deals with types of court-martials and not discharges:

Qualifying Conviction

The amendment only applies to a qualifying conviction. A qualifying conviction consists of two elements; (1) a misdemeanor domestic violence crime, and (2) a conviction.

First, a misdemeanor domestic violence crime is an offense that is a misdemeanor under federal or state laws. The crime must include the use or attempted use of physical force, or the threatened use of a deadly weapon. The criminal act is considered domestic violence when the offender is the current spouse, the former spouse, the parent, or the guardian of the victim. The offender can be someone who shares a common child with the victim, cohabitates or used to cohabitate with the victim, or is similarly situated to a spouse, parent, or guardian of the victim.

Second, the offender must be convicted of a domestic violence crime through any of the following: a state court, federal court, special court-martial, or a general court-martial. However, a conviction does not include convictions from a summary court martial, Article 15 non-judicial punishment, deferred prosecution or diversion in a state or federal court, or convictions that are later set-aside or expunged.

Watch for stocks to fall further for Academy Sports, if they were on the market. Academy Sport & Outdoors was acquired by the private equity firm Kohlberg Kravis Roberts & Co L.P. in August 2011.

Twelve months confinement is pretty harsh; I’d like to see the facts in the case. I suspect this guy was a real piece of work (no kidding - he’s a mass murderer).
