There is no death penalty in New York. Send him to Gitmo. Try him there with a military tribunal and execute him under Federal Law.

Judge Nap says he can’t get death penalty at Gitmo. But if tried in Federal Court he can be executed. I don’t know if that is true, but I want him dead. However that can happen, I’m for it.

I’m not a lawyer but I’m pretty sure it doesn’t matter if he crossed state lines. His connection with ISIS makes him an agent of a foreign terrorist organization under Federal law.
I believe there are Federal laws that provide for the death penalty for one who murders as part of a terrorist act. Sessions needs to go after this guy hard with the full weight and maximum penalties of US law.
