GOP Senator Asks Trump If He’s ‘Recanting’ Constitutional Oath

Nebraska Sen. Ben Sasse issued a statement asking President Trump is he is “recanting” the oath he took to defend and uphold the Constitution after Trump suggesting revoking the “licenses” of network news organizations.

“Mr. President: Words spoken by the President of the United States matter,” the Republican senator wrote in a statement. “Are you tonight recanting of the oath you took on Jan. 20 to preserve, protect, and defend the 1st Amendment?”

Sasse’s tweet came after Trump sparked backlash from both conservatives and liberals by saying he should censor certain news outlets.

“Network news has become so partisan, distorted and fake that licenses must be challenged and, if appropriate, revoked. Not fair to public!” Trump wrote.

“With all of the Fake News coming out of NBC and the Networks, at what point is it appropriate to challenge their License?” Trump asked in another tweet.

Actually, a court cannot review legislation unless it is brought before the court. An aggrieved party would need to bring it with the attendant question of standing which you raise.

The following is not a response to you but to others on the August Forum.

I recognize that the MSM is doing its best to make the Donald look bad and that inaccurate stories regarding his actions abound. I voted for Trump but am very tepid in my support of him. However, the unfair assaults on him by the MSM and the Establishment are causing me to increase my support of him. I get it!

However, the First Amendment far outweighs the unfairness of the MSM portrayal of him. If we pass some sort of legislation allowing for oversight of the MSM’s reporting, then let’s remember that unfortunately someday the Opposition will again be in control of the Congress and/or the White House and will control that oversight (with a vengeance). The same issue pertains if the renewal of broadcast licenses is predicated on some sort of review of the licensee’s journalism.

I suspect that most, if not all, of the correspondents of the August Forum want to minimize government power, especially Federal government power. But now, because the Donald said it, you want to give the Federal government power over what can be reported in the news?

However, do you remember when 0bama was harassing reporters like James Rosen, Sharyl Atkisson, some AP reporters, and others? We all rightly condemned it.

Only because Obama was going after people who were slightly competent.

The media has incredible power, power over the hearts and minds of millions of people, operating as a gatekeeper for what is true and untrue about the world around them.

No one elected them to be responsible for our minds. At a bare minimum, regulation of the news media is expected and even absolutely necessary.

Of course, some people will say, "but if we do this, they'll come after us when they come to power!" Hillary Clinton was already planning to screw us to begin with. Obama's transfer of ICANN to the UN was also designed to set us up for further censorsing and control. There is nothing that will stop the Left from crushing us once they have the power to do so.

The only way we win is by fighting to win, absolutely. Total war is the name of the game, and if you don't play it, you'll just get walked on.

Other than giving aid and comfort to the enemy in time of war, or crying fire in a crowded theater (causing panic — a safety issue), freedom of speech is pretty much absolute.

When they lie, there are libel laws in place. They should be used.

But under the First Amendment, the government cannot undertake action that threatens free speech. Private entities can, the government can’t. If you thought it was wrong when 0bama went after journalists, then it’s wrong when Trump threatens to do it. Neither can use governmentn power against reporters.

freedom of speech is pretty much absolute.

I would like to know more about the FCC licensing standards, their legal foundation, and also if we can strip these licenses.

I don't think the Founding Fathers believed something like a globalist, corrupt, ideologically insidious force such as Hollywood and the media would ever ever rise up.

We should work towards destroying the media using any means possible. Ideally, it would be beautiful to bust up this monopoly of just a handful of major companies controlling all our media. Even better, imagine laws--restricted to cable and regular tv--that make it ILLEGAL for a network to broadcast out of a particular state! They get ONE state! Independent ownership!

Ah, it's nice to dream.

Such a law would be unconstitutional.

The FCC’s standard is “the interest of the community.” You can’t get licenses stripped for content. That would ba a First Amendment violation.

If that's the standard then it sounds like we can do a GREAT deal to limit or even remove power from the media!
