Uh yeah, if they did not want to get charged with aggravated weapons charge, they should have followed IL state and Cook County guidelines.

BTW, am not commenting on whether or not the laws are Constitutional, I am stating what laws were broken in IL and likely more in Cook County.

There are laws that I don’t like and I don’t think are Constitutional, but I follow them.

In IL, you can CC with a CC permit. If they had a permit, they could have a loaded weapon in front seat...If they don’t, they should have followed local and state laws. Which I stated as locked, field stripped, with ammo locked separately in the trunk.

I believe the CC laws stem in part from a concern for law enforcement officer safety. They don’t want to walk up to a car and be shot while on what initially seems to be a routine traffic stop.

As far as firearms in your house, I don’t know that there are IL laws regarding keeping them locked up in a cabinet with a trigger lock, and ammo locked separately. I never said that...I was talking about in vehicle.

I will say, in your home, if you don’t keep them safely away from everyone except yourself; as weapon owner, you would be in a boatload of trouble if someone was injured with one of your firearms.

BTW, their timing to be in town for Chicago Marathon with a pressure cooker, and carrying an AR 15 and handgun in car was either really stupid or indicating they were up to no good...

My understanding of Illinois law is that it must be either 1. not accessible, 2. disassembled, or 3. unloaded and cased.

Any one of the three makes you legal, you don’t have to do all of them.

[[BTW, am not commenting on whether or not the laws are Constitutional,]]

Didn’t mean to imply you were- I was commenting on the constitutionality of the idiotic laws in the state-

[[I don’t know that there are IL laws regarding keeping them locked up in a cabinet with a trigger lock, and ammo locked separately. I never said that...I was talking about in vehicle.]]

Again- my comment was simply to point out that states erode our second amendment rights by passing laws like that-

[[ you would be in a boatload of trouble if someone was injured with one of your firearms.]]

Life sucks sometimes- but tragic accidents are very very rare- more kids drown in pools and/or five gallon pails and bathtubs than get shot by guns lying around - the point is that we DO have a right to self protection and you can’t protect yourself during a home invasion when your gun and ammo are scattered all over the house-

Where do you draw the line? Crime in cities is rampant- breaking are rampant- where do you draw the lien between locking away guns ‘for the extremely rare cases of children shooting themselves’ and criminals breaking in?

According to the FBI
in the US:
www.fbi.gov
o
One property crime happens every 3 seconds.
o
One burglary occurs e
very 10 seconds.
o
One violent crime occurs e
very
20 seconds
.
o
One aggravated assau
lt occurs every 35 seconds.
o
One robbery occurs every 60 seconds, or 1 minute.
o
One forcible rape occurs every 2 minutes.
o
There were over 2 million burglaries in 2005.
o
An increase in burglary offenses was the only property crime to increase in 2005 compared with the prior year data.
Home Invasion Facts:
o
According to a United States Department of Justice report:
ß
38% of assaults & 60% of rapes occur during home invasions.
ß
1 of every 5 homes will experience a break in or home
invasion. That’s over 2,000,000 homes!
o
According to Statistics Canada, there has been an average of 289,200 home invasions annually over the last 5 years.
o
Statistically, there are over 8,000 home invasions per day in
North America
o
According to Statistics U.S.A., there was an average of
3,600,000 home invasions annually between 1994 and 2000.

The bottom line is that you are far far more likely to be assaulted by criminals in your home than you are to face having someone shoot themselves with one of your guns
