Judge formally dismisses Arpaio's criminal case

A federal judge has upheld the validity of former Sheriff Joe Arpaio's pardon despite claims from critics that letting his clemency stand would encourage officials to disobey future court orders.

Judge Susan Bolton cited U.S. Supreme Court precedent Wednesday when she formally dismissed the criminal case against the former six-term sheriff of metro Phoenix.

Two months ago, Bolton found Arpaio guilty of disobeying a court order to stop his traffic patrols that targeted immigrants.

The ruling comes five weeks after President Donald Trump pardoned Arpaio's conviction for disobeying a 2011 court order to stop his traffic patrols that targeted immigrants.

Prosecutor John Keller says the pardon ends the case and that Arpaio will never be held accountable for defying the order.

Arpaio will never be held accountable for defying the order

The order was unlawful. Joe was under no legal obligation to follow it.

She realized she didn’t have a legal leg to stand on and didn’t want to be royally smacked down by the Supreme Court who has for 230+ years ruled the presidential pardon power is dang near absolute.

I’m pretty sure those very same critics have no problem with officials destroying hard drives, phones, laptops, iPads, hard drives, erasing over 30k emails about yoga and weddings.

The hypocrisy is enough to drive you insane.

The pardon was never in doubt here, despite the ignorant hysterics you'll find all over FreeRepublic on this matter.

President Trump issued his pardon after a motion had already been filed by Arpaio's legal team to have his original conviction overturned. Arpaio could have just dropped the whole thing at that point, but there was apparently some legal technicality in play that motivated him and his lawyers to insist that the judge consider the motion anyway. I believe it had something to do with the way Arpaio's legal record would be documented if he ever needed a security clearance in the future (or something like that).

For whatever reason, Arpaio and his lawyers decided that having his original conviction overturned was preferable to having the charges disappear through the pardon.

The judge was never going to overturn Arpaio's pardon under any circumstances.

This story is bogus. She did not rule that the pardon was valid.

He asked for the charges to be dismissed on other grounds and that is what she ruled on.

Sheriff Joe was charged and convicted for doing his job!!!!

He should not even have needed a pardon! And perhaps he should be made Secretary of Homeland Security, even though the Senate will never allow it!!!!

Her ‘mistakes’ (read politicization of the case) will now go down the rabbit hole. I suspect she may have been found to have violated her oaths as Judge, if she had let the case stand.

The Judge’s order is moot.

In fact, all those who thought a Judge and/or prosecutor should or could overturn a POTUS pardon are stupid or corrupt or both.
