The tree-trimming company Asplundh Tree Expert has been hit with a $95 million fine for knowingly hiring illegal immigrants and for bringing on some under different names who used documents it knew were fraudulent.
It is the largest fine ever in an immigration case in the U.S.
Asplundh pleaded guilty to criminal charges in federal court in Pennsylvania, where it is headquartered, admitting that its managers restructured the company's hiring specifically to evade normal human resources processes and hire illegal aliens, many by word-of-mouth, while giving top-level managers deniability.
The $95 million fine includes forfeiture of up to $80 million in profits that the company earned as a result of its hiring of illegal aliens, plus a civil fine of $15 million.
The federal lawsuit brought against the company by the Department of Justice named manager Larry Gauger as plaintiff in addition to the company, saying he instructed managers working under him to hire people they knew were illegal aliens.
But what made things worse, and the fine no doubt much larger, was that the company, and Gauger, set up a system to hire illegal aliens after a government audit and in outright defiance of the government.

Fines are just a cost of doing business. Jail time for the upper crust however . . .
It is very simple ... you will. Asphlund is the company that cuts trees for the Utilities. You know, when there is a storm and trees blow onto the lines and your power goes out? Asphlund is the company that removes the trees from the lines so that the utility can hook the wires back up. That being the case, your utility bill will go up to pay the fine.
Sad when the government decides which businesses go under and which ones survive.
The managers of the company should lose their jobs. With 90 million people not working in the US, you can be sure another company will pick up the slack. First the welfare needs to be converted to workfare.
No mercy should be shown here. None.
They decided to go out of business when they decided to run a criminal enterprise. That was their decision.
Not to mention roofers.
Yes, like it or not, there are jobs Americans don’t want to do.
They’ll just raise prices to cover the fine. They should have been perp walked to jail.

We had a construction company for many years and lived in fear of getting nailed for hiring illegals. In recent years I know many many companies made it a practice to hire, depending on the work being done, Mexicans who were generally known to be cheaper and better workers than the union types - who would often go over their paychecks on Friday while reading to us from their union book.
Bill Clinton was the first prez to do it when he went after Tyson Chicken. In that case a couple of local plant managers were convicted but everybody at corporate level escaped.
GW Bush got convictions against IFCO Pallet company and a couple of smaller companies.
Usually they go with a civil prosecution because that is much easier and cheaper to convict. And, with a civil prosecution they can back off of the case if it isn't looking good and switch to administrative fines.
Usually the defendant will quickly agree to administrative fines because he doesn't have to admit to guilt and the administrative fines are less than the cost of hiring a lawyer.
Asplundh must not have been paying the illegals FICA(Social Security and Medicare)taxes. Doing that will usually keep the Feds looking the other way.
Good start.

No cost is too high to set an example. These execs should be doing the frog march. One or two high publicity cases would turn this whole thing around.

Same here in Texas. They usually come thru every year and trim all the power line right of ways in our neighborhood. Haven't seen them this year. Wonder if this is why?
