Maryland is suing the U.S. Environmental Protection Agency for failing to act on a petition requiring power plants in five upwind states to reduce pollution, the states attorney general and an official in Gov. Larry Hogans administration said Wednesday.
The Hogan administration says 70 percent of Marylands ozone problem originates in upwind states.
Maryland petitioned the EPA in November for a finding that 36 power plant units in Indiana, Kentucky, Ohio, Pennsylvania and West Virginia are emitting air pollution affecting Maryland in violation of the Clean Air Acts good neighbor provision. In January, the EPA issued a six-month extension to the act, setting a July 15 deadline that Maryland officials say expired without action being taken.
Were saying in the lawsuit: EPA failed to do its job, said Maryland Attorney General Brian Frosh, a Democrat. Were getting pollution from these other states. We asked them to do something about it, and they did nothing. They didnt hold a hearing. They didnt issue orders to Kentucky or Pennsylvania or any of their utilities to reduce their emissions, and so Im not sure what their response is going to be, but its a very straightforward matter. Were right. Were breathing their polluted air and theyve got to stop.
The lawsuit was filed Wednesday in U.S. District Court in Maryland. The EPA did not immediately respond to an email request for comment about the lawsuit.

Maybe Maryland could sue China for polluting air for the entire world...
I suspect that our Atty Gen Frosh is a fudge packer.
If Hillary was in office this would have never happened. The filing of a complaint against the EPA, that is.
That AG in MD is a loose cannon. Anything to pressure Trump.
The Guv needs to rein him in.
Maryland is whacked.
Cut back emissions by cutting off Maryland from receiving power from those dirty ol’ coal plants. Let them get their power From the wind farms in the Chesapeake. That outta take a couple of conventional units offline.
Wait. What’s that? There aren’t huge wind farms in the Bay? It would spoil the sailing? Oh.
I love Maryland and the bay, but man do they elect some morons.
The EPA will get right on that-—as soon as they clean up that river in Colorado that they ruined.
But really, only 4-5 counties, and one City are “whacked”.
Rep. Andy Harris erects new obstacle in path of Md. wind-farm projects
Harris, whose district includes Ocean City, said the amendment was necessary to protect seaside views and property values. But Paul Rich, director of project development for U.S. Wind, said the amendment effectively kills the project. ... Harris, the only Republican representing Maryland in Congress, is known for blocking laws he opposes in the District, including the citys pro-marijuana initiatives and the Death with Dignity legislation.
The republican MD governor signed a fracking ban.
WV wants to increase gas supplies to the eastern panhandle, the preferred way was to bring it down from PA through MD. Maryland did not like the idea so much, WV is now likely to keep it within the state.
It appears Marylanders don’t like electricity from evil coal and gas and oil that comes from fracking, enjoy paying your utility bills.
Same deal with NY and New England. I’m in the industry and it would be mutually beneficial to sell them some cheap shale gas. But the people there have swallowed the anti-fracking propaganda. Fine. Freeze in the dark.
Sorry to the couple of folks still there who have their heads on straight. Come on up to PA. We could use the votes. We’re barely keeping the barbarians at bay now.
Why is Hogan teaming up with Fr0sh on this one? Ozone pollution. I don’t notice, but I may be less sensitive to it since I quit eating the noxious weed known as wheat.
Governor Larry H0gan: our environ-MENTAL GOP governor.
Maryland “Freak State” PING!
I voted for Hogan, not knowing that he would be so environ-MENTAL and go along with the fracking ban, RGGI and now this nitwit lawsuit.
So if 70% of pollution comes from other states, why are we forced to have emission tests done? Seems it’s time to eliminate that entire program.
Exactly. India does its fair share, as well.
Why is Hogan teaming up with Fr0sh on this one?

Hogan is a RINO.
