like others have said it depends on the age. Some years ago there was a widely reported case here in Atlanta of some moronic 20 something who was aught trying to have sex with a 13 year old girl in her house. Sounds like your standard pedophile right? However, the girl set the whole thing up, Her idea from start to finish. The girl lured the guy with online posts. She trolled for weeks to catch someone to have sex with - the whole 9 yards, The guy was just a dumbass who though his dream came true. I remember the county prosecutor saying that he regretted that he couldn't do anything to the girl, but she was too young to face any consequences. The guy got jail time and a permanent label as a sex offender.

So I would say in her case 13 might not have been too young.
