Where Would Trump Be If He Had Run as What He Is: the Amnesty Candidate?

One of the great ironies of the 2016 campaign is that Donald Trump, who has run as the immigration scourge, is actually the amnesty candidate.

Trump has expressly vowed to give legal status to millions of illegal aliens. For any other candidate, such a promise would have been the campaign death knell. To compare, John Kasich -- who is openly pro-amnesty -- has lost 38 of 39 primaries (the sole exception being his own state) and has never been a plausible contestant. When it comes to Trump, however, it seems that the all-important amnesty fine-print of his immigration position has been overlooked. This is no doubt due to his consciously controversial rhetoric: his fixation about building a wall on the Mexican border, his oft-repeated commitment to mass-deportation of illegal aliens, his disparaging comments about Mexicans, and his proposed moratorium on Muslim immigration.

Yet, Trump is the amnesty candidate. What’s more, the amnesty component of his immigration plan is the only part that has a realistic chance of happening.

Trump is not going to build his wall, much less make Mexico pay for it, as he has insisted our southern neighbor will do. Quite apart from the fact that much of the border is not suitable terrain for wall construction, his wall would be astronomically more expensive to build than he has estimated, and in any event, Democrats and many Republicans in Congress would block funding for it. (To be clear: I favor construction of walls and/or fencing where practical; but a wall is only one component, and not nearly the most critical one, of what must be a multi-faceted strategy if we are to be serious about border security.)

Trump’s categorical moratorium on Muslim immigration would also be rejected.

Congress has the power to make the laws.

He has the requirement to enforce the laws, maybe he could just enforce a few of the immigration laws that are on the books. He doesn't have to threaten to withhold money from these Sanctuary Cities/States just arrest them. He could use these old laws already on the books.

Federal Immigration and Nationality Act
Section 8 USC 1324(a)(1)(A)(iv)(b)(iii)

“Any person who . . . encourages or induces an alien to . . . reside . . . knowing or in reckless disregard of the fact that such . . . residence is . . . in violation of law, shall be punished as provided . . . for each alien in respect to whom such a violation occurs . . . fined under title 18 . . . imprisoned not more than 5 years, or both.”

Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):

A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

• assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or

• encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or

•knowingly assists illegal aliens due to personal convictions.

Penalties upon conviction include criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime. Anyone employing or contracting with an illegal alien without verifying his or her work authorization status is guilty of a misdemeanor. Aliens and employers violating immigration laws are subject to arrest, detention, and seizure of their vehicles or property. In addition, individuals or entities who engage in racketeering enterprises that commit (or conspire to commit) immigration-related felonies are subject to private civil suits for treble damages and injunctive relief.

Recruitment and Employment of Illegal Aliens

It is unlawful to hire an alien, to recruit an alien, or to refer an alien for a fee, knowing the alien is unauthorized to work in the United States. It is equally unlawful to continue to employ an alien knowing that the alien is unauthorized to work. Employers may give preference in recruitment and hiring to a U.S. citizen over an alien with work authorization only where the U.S. citizen is equally or better qualified. It is unlawful to hire an individual for employment in the United States without complying with employment eligibility verification requirements. Requirements include examination of identity documents and completion of Form I-9 for every employee hired. Employers must retain all I-9s, and, with three days’ advance notice, the forms must be made available for inspection. Employment includes any service or labor performed for any type of remuneration within the United States, with the exception of sporadic domestic service by an individual in a private home. Day laborers or other casual workers engaged in any compensated activity (with the above exception) are employees for purposes of immigration law. An employer includes an agent or anyone acting directly or indirectly in the interest of the employer. For purposes of verfication of authorization to work, employer also means an independent contractor, or a contractor other than the person using the alien labor. The use of temporary or short-term contracts cannot be used to circumvent the employment authorization verification requirements. If employment is to be for less than the usual three days allowed for completing the I-9 Form requirement, the form must be completed immediately at the time of hire.

I actually read this article as them wanting Trump to stick to his campaign promises.

That is enough to get you labeled a #NeverTrumper here.

These various rumors flying around are the fault of One Man, President Trump.

I thought I got all of his tweets, I just reviewed them, there wasn’t a single one in there that even referenced Pelosi or Schumer, let alone any that called them Liars.

my question to these apologists. Are you supporting all of these things:1. no debt ceiling? 2. no wall 3 amnesty 4 daca 5. cozying up with shumer and pellosi? Just yes or no. By the way — AMNESTY has never been about citizenship. It is about being rewarded for breaking our laws with welfare , healthcare social security — . Hopefully we can block it with the filibuster ( OH Ill bet McConnell does away with the filibuster just on this) This “DEAL” is AMNESTY!! to say it is not amnesty is a bald faced lie. Just because we all supported Trumps election does not mean that he can just go to hell without criticism.

The answer is you would have President Hillary.

Donald Trump is the only Republican who could have beaten her, and he did.

With Hillary you would have the most Liberal SCOTUS in History as well as the Lower Courts and the second amendment would be a distant memory.

There is no debt ceiling, it is nonsense that should be removed.

Every year it is simply increased.

And it is Congress that should be dealing with that issue, not Trump.

As for children who were brought here by their parents, they didn't break any laws, their parents did!

As opposed to those that wear blinders. Not being as bad as the other guy is not really an endorsement because the other guys could have been really, really bad. By the way we didn't elect any of those other guys so it doesn't really matter how bad they might have been compared to President Trump.

President Trump could put and end to all this by just making it clear that his campaign promises were exactly that and they would be kept. He might also try firing a few of the #NeverTrumpers he has on his staff, instead of sending surrogates here to trash his loyal base, because they don't bow down and faun over every 32D chess move.

Interesting that within a few days of her heinous revealing that she is “done as a candidate”, comes this big wave of never-trumpism. Guess they think this is a good time to intensify the attacks, as they can no longer be accused of wanting Hillary as POTUS (supposedly).

Yeah, I suppose that if and when Trump does something I do not consider conservative, such as amnesty, I will be unhappy but I will still recognize that it could have been worse if the Wicked Witch or Jeb! or someone like that was president instead. That would not make me “happy” or satisfied but I guess it would take the edge off.

I think all this is a bit premature because the one thing we know is that this must get through Congress and there will definitely be GOP members fearful of a primary challenge from the right. They will be less scared if the president has explicitly endorsed a particular bill, so I hope he does not do that but note that this is exactly what Ryan and McConnell are pushing for. They want a WH proposal that gives cover to conservatives voting for it.
