Immigrant who says he was wrongfully deported could be brought back to U.S. for trial

A federal judge is expected to order the first known deported DREAMer to be allowed to return to the U.S. to make his case about why he should be able to stay in the country.

Judge Gonzalo Curiel, of the U.S. District Court for the Southern District of California, has said he wants a speedy trial for Juan Manuel Montes, the 23-year-old who was formally part of the Deferred Action for Childhood Arrivals (DACA) program.

Montes was arrested by Border Patrol agents in February 2017 after he was caught illegally entering the U.S., according to the Department of Homeland Security.

Lawyers for Montes allege that he was just trying to return to the U.S. after initially being wrongfully deported. Lawyers are scheduled to meet with Curiel Wednesday to discuss the upcoming trial.

This is one of many reasons I am just done, no matter how you look at it this person was illegal, and violated the rules of DACA. No matter what we do for the illegals, it is never enough and never will be. We need to deport all illegals and only deal with those that have been and are trying to come to this country the legal way.

So the guy went voluntarily to Mexico, and LIES about it.

Judge talks as though it’s the fault of ICE that there is no record of a deportation that never happened!!!!!

The DACA legislation being readied in congress plans to excuse criminality related to their illegal status: identity theft, social security fraud, tax evasion...

This “dreamer” is not in this Nation, therefore has no rights to petition our court system. Trump needs to defy this “federal judge” with obviously divided loyalties.

The Juan Manuel Montes's, an "undocumented illegal citizen" ...broke the law...does Juan, being illegal allowed a trial even in California...paid for by all Californians?

DACA is unconstitutional...Obama never asked congress, just did as he wanted to.

DACA is owned 100% by ex-president obama....put that man, now a private citizen on trial for crimes against illegal aliens and USA citizens.

This is all just craziness. Try to go to another country illegally with all these expectations! We used to believe as a country that we needed to take care of our own first.

You would think he would have no right to do this, but I won’t be surprised if the court allows it. Wrongfully deported? I can imagine the laughter if a U.S. citizen tried all this in Mexico.

Ah....this is about the judge and Trump. IIRC, This was the judge born in Mexico whom President Trump frowned upon.

This is the same judge that Trump got in trouble over pointing out he was Mexican and belonged to a La Raza legal association.

Seems like we are besieged by some powerful and mysterious interests that believe America should belongs to the world. Our sovereignty is under attack on many fronts. This illegal immigration business is just one of those fronts.

I agree it is one of many. I also have always thought it will end up being the biggest battle. There is tons of money in the cheap labor express, those who are getting that money will not give it up without a hard fight.

He should have lost his (illegal) DADA status when he left the US. When he was stopped this time, he was nothing but another of millions and millions of illegals in need of swift legal deportation.

Curiel presided over a lawsuit involving Trump’s now-defunct Trump University, and the then-presidential candidate called into question the judge’s impartiality due to his Mexican heritage

My, my, just a coincidence, huh.
