Joe Arpaio saga isn't over: Judge to decide if his conviction stands

U.S. District Court Judge Susan Bolton canceled former Sheriff Joe Arpaio's upcoming sentencing hearing for his criminal contempt-of-court conviction, telling attorneys not to file replies to motions that were pending before his recent presidential pardon.

However, Bolton on Tuesday stopped short of throwing out the conviction based solely on Arpaio's request. Instead she ordered Arpaio and the U.S. Department of Justice, which is prosecuting the case, to file briefs on why she should or shouldn't grant Arpaio's request.

Bolton has scheduled oral arguments on the matter for Oct. 4, the day before Arpaio was supposed to be sentenced.

There is case law that says a pardon implies an admission of guilt, and that will have to be argued in open court.

I wonder is this some ploy. Would the judge, now after the fact, decide to throw out the verdict she herself handed down and let it all go just to try and embarrass Trump, then making the pardon irrelevant?

That add fuel to the fire that Trump should have waited until all legal proceedings were over before making the decision.

Hah - if the judge interferes, the President can and should order the US Marshal to execute his order. Arapaio’s lawyer’s brief should consist of the pardon only - it is self-explanatory. If the judge orders any punishment, who is she going to get to enforce it?

The Marc Rich case was unusual because he remained a fugitive long after he was pardoned. The President of the Untied States has the authority to grant pardons in Federal cases, but I believe Rich was also facing a number of criminal charges in New York or another state.

Its not over until Arpaio says its over.

I think he plans to push it as far as it can go. He wants the conviction annulled.

Because he doesn't want the barest shadow of a doubt about his innocence to be hanging over him when he proceeds with the BO BC investigation with full force.

...not sure you can pardon someone who has not yet been convicted. Maybe Trump jumped the gun on this one.

He has been convicted. The Oct. date is when sentencing is scheduled. Since he has been pardoned for the conviction, there should be no need to go through the sentencing hearing.

Here is the law.

A conviction is never final until all appeals are exhausted. A pardon prior to appeals being exhausted voids any alleged conviction.

Famous example: Ken Lay was convicted in the Enron case. Mr. Lay died prior to his appeals being exhausted. The court vacated his conviction on a motion by the prosecutor.
