So who exactly owns the beach? Is it part of the legally described deed? Or is the beach considered public property or a public right of way?
If this guy has legal ownership of the beach, then the state is in the wrong.
If he’s blocking access to public property, then he’s in the wrong.
I believe ocean front home property lines extend only to the mean high water line - outside of that are the navigable waters of the United States.
The way I understand it the guy does not own the beach he owns the road people want to use/trespass to get to that beach. Does every land owner have to provide access through their property if next to public land?
