CEDAR CITY The issue of Utah prairie dogs may be on their way to the U.S. Supreme Court after an appeals court refused to hear arguments this week regarding an earlier ruling that found a federal judge had erred in his 2014 decision.
In 2013, attorneys for People for the Ethical Treatment of Property Owners filed a lawsuit against the federal government challenging its regulation of the Utah prairie dog and its impact on property rights. Members of PETPO include private property owners as well as entities such as Cedar City Corporation, who claim the burrow-dwelling rodents are damaging property and causing economic harm.
The lawsuit argued that the Commerce Clause of the U.S. Constitution doesnt allow the federal government to regulate animals found on private land in only one state as is the case with Utah prairie dogs. The group requested relief from the federal protections provided under the Endangered Species Act.

Just came back from Colorado vacation ... my step daughter lives across the street from a flat field with nothing but prairie dogs. She mentioned a developer cleared the land but could not begin development due to a short spurt of bad weather. During that bad weather the prairie dogs moved in ... and since they are a protected species in Co, development had to be cancelled. Nothing but a field with prairie dogs now.

Well, little fuzzy cute creatures have a place. Right next to the mashed potatoes. Although prairie dog is not a culinary choice for most. :-)
I lived in Colorado 35 years ago.
A Rancher between Boulder and Lyons welcomed us with open arms to help rid him of the little rodents.
This was pre California migration.
“People for the Ethical Treatment of Property Owners”
I love it!
“regulation of the Utah prairie dog”
This is how the commies shut down business and development.
There is no significant difference from the above w/any other prairie dog.
Taken in sum, the prairie dog population would not be a candidate as an endangered species, so they come up w/a faux taxonomy to ensure it does.
If Utah did not provide a small enough “demographic”, they’d probably start breaking it up by zip code such as “The Salt Lake City 84101 Prairie Dog.”
I had to go to AZ. on a June 17 to shoot the damn things. South Dakota was $500/day. Wyoming requires no license I understand. There are plenty of them out there in need of ‘control’. There’s not much help in finding out.
.223 hollow points do a fine job too.
22-250 for me.
Exploding Prairie Dogs?.......................
” Nothing but a field with prairie dogs now.”
Boulder county actually has a crew that counts Prairie dogs. Really. These people are insane.
Would be a terrible shame if someone dropped poison bait in the middle of the night.
if it works, can they drop it in Afghanistan too?
Unfortunately the pests there are a little harder to kill. But I agree we should’ve started dropping stuff.
