JUSTINE Damonds killer cop doesnt have to talk about why he shot her but if he wants to keep his job, he will be compelled.
The Star Tribune reports that Officer Mohamed Noor has a constitutional right not to talk with anyone pursuing possible criminal charges in her shooting death.
But if the Minneapolis Police Department opens an internal investigation, the law will force him to talk if he wants to keep working as a police officer.
However, if he gives a statement theres another cruel twist. It can never be used in a criminal case.
In Minnesota, public employees under internal investigation are now read a Garrity Warning, which says that though they are not legally required to say anything, their employer requires it. If an employee doesnt cooperate, or lies, they could lose their job.
But the statement says any information gathered cannot be used in a criminal case.

I find this information very concerning.
They are just stating the obvious. You are not required to testify against yourself, whether you are a cop or not. However, if you ARE a cop, you have to comply with an investigation, IF you want to keep your job.
Nothing unusual here.
I though the office was considered to have legally dispatched with government property?
Does anyone know whether any charges have been filed yet in this case? Seems like that would be normal, if he could not be immediately exonerated, then there should be charges, IMO.
I'm sorry the killer cop is still breathing, much less still employed.
Getting fired is hardly as cruel a fate as Ms Damond’s.
Even a half-assed prosecutor could pursue this case without using any statements from the police officer.
You fail to mention he is now assured a place in muslime heaven because he killed a non muslime infidel.
He is also a hero to all other muslimes
That is not a blanket waver. The statements can't be used against him in the shooting case, however if he lies or is not forthcoming he could be charged with obstruction of justice or some such.
Let's get that message echoing across the land.

Why would you think that?
Just because his statement is not admissible, it doesn't mean there is no case against him.
There is still the forensic evidence that the bullet came from his gun, there is his partner's testimony, and the process of elimination that it is most clearly he who pulled the trigger.
They don't need his testimony to try him for at least manslaughter. I'd think the best that his own testimony would provide is evidence of 1st or 2nd degree murder, which implies intent or reckless disregard.

You can not be compelled to testify against yourself. That is what the 5th is all about. Now, you can blow it by answering some questions and refusing to answer others.
My understanding is that the game prosecutors play is to ask you a bunch of questions and if you answer just one, you have to answer them all. So they try to trip you up with something minor. That is my understanding. I could be wrong. I was wrong one in grade school, so it’s always possible. :)

No charges yet. If the officer claims fear for his safety then I doubt there ever will be.
Not if the officer pleads fear for his life. Dark night, victim appeared out of nowhere and startled them, officer shoots. Tragic, but justified. Officer is fired. Victim's family collect large settlement. Life goes on.
So, it’s to Mohamed’s advantage to answer any internal affairs questions as quickly and as thoroughly as possible, since nothing he says can be used against him, and his attorney can always argue in court that any evidence presented against him was based on what he said to investigators.
This would certainly be a first: a muzzie telling the truth...
