New York Times: Sarah Palin wants all internal communications about her since 2011

Lawyers defending the New York Times say Sarah Palin is overreaching in her defamation lawsuit against the paper, and argue the case should be thrown out.

Court papers filed by lawyers for the Times say Palin's legal team is attempting to subpeona "twenty-three non-party current and former Times reporters, editors and other employees — most of whom had nothing to do with the editorial at issue," according to a Wednesday report by the New York Post.

Stipulate that malice is not a requirement, and the material won’t be needed. At a minimum, she’s entitled to in camera review by the judge. More fairly, her attorneys should be entitled to see it under a protective order, and then they can argue to the judge before trial if it is relevant or not.

They could save themselves a lot of embarrassment as well as a ton of legal fees, if they would just stipulate to the fact that the editorial was false and that it was done with malice.

That would end all the depositions and subpoenas. At that point the burden would be on Sarah to establish damages.

If Clinton had just allowed the Paula Jones lawsuit to go into default, he could have saved himself a lot of grief and a ton of attorney fees. Instead, his stupid attorney decided to fight it and lose.

The NYT should take a lesson from Clinton. Don’t fight battles that will cost you your reputation and a ton of money when you are simply as guilty as hell.

Instead the NYT is going to spend millions of dollars and they are going to end up paying Sarah Palin’s attorney fees and a ton of money.

Even if the jury doesn’t find for Sarah, the discovery on this is going to be worth every penny. Let the depositions begin!
