The highest court in Massachusetts ruled Monday it is illegal under state law for local law enforcement officers to hold people on detainer requests by U.S. Immigration and Customs Enforcement.
An ICE detainer is as a voluntary request to hold a person in custody for up to two days while ICE looks into the person's immigration status. States that do not adhere to the detainers say the person's criminal proceedings have already been settled and holding them for 48 hours longer violates their constitutional rights.

Massachusetts: Calling all criminal illegals
Congress has to make entering the U.S. Illegal a felony
Is there a state more loathsome than Kennedychusetts?
Last time I checked a state court (even a state Supreme Court) couldn’t overrule federal law. (and in some cases I wish it could because Federal Gun law would by bye-bye in large swaths of the nation)
They ruled it is illegal for state law officers to hold people for federal crimes...
Let me repeat -
They ruled it is illegal for state law officers to hold people for federal crimes.
That’s unconstitutional on its face and secessionist rhetoric.
Liberal Judges in this country are begging to be purged.
Whatcha gonna do about it DoJ?
Crack down on pot users, obviously.
The Congress can pass a law saying that states have to honor federal detainers. There is currently no such law; a detainer is, as the article itself says, a "request."
Illegals do not have Constitutional rights - they have UN world rights but not ours.
Or, seize someone’s assets....
Let me add: They’re subject to our laws however which means if you’re in our country illegally you are subject to our laws of being here illegally. Our wonderful state department incarcerated an Australian girl because she over stayed her three week visa by one day, was caught as she was >leaving< the US - her parents went frantic because she was also held incommunicado with anyone including her embassy.
“Whatcha gonna do about it DoJ?”
I’m sure do-nothing Sessions has already recused himself on this.
So Massachusetts Supreme Court believes in Nullification?
Yes, this needs to happen ASAP.
This is the court that gave the world gay marriage. What a piece of work!
“and holding them for 48 hours longer violates their constitutional rights.”
Dear MA supreme court: Non citizens, a/k/a illegal aliens have no constitutional rights.
Massholes.
