Massachusetts Supreme Judicial Court rules ICE detainer requests are illegal

The highest court in Massachusetts ruled Monday it is illegal under state law for local law enforcement officers to hold people on detainer requests by U.S. Immigration and Customs Enforcement.

An ICE detainer is as a voluntary request to hold a person in custody for up to two days while ICE looks into the person's immigration status. States that do not adhere to the detainers say the person's criminal proceedings have already been settled and holding them for 48 hours longer violates their constitutional rights.

Last time I checked a state court (even a state Supreme Court) couldn’t overrule federal law. (and in some cases I wish it could because Federal Gun law would by bye-bye in large swaths of the nation)

The Massachusetts Supreme Court was slapped down by SCOTUS recently (9-0) on one of their 2nd Amendment decisions.Let's see if it happens again.

The Congress can pass a law saying that states have to honor federal detainers. There is currently no such law; a detainer is, as the article itself says, a "request."

Let me add: They’re subject to our laws however which means if you’re in our country illegally you are subject to our laws of being here illegally. Our wonderful state department incarcerated an Australian girl because she over stayed her three week visa by one day, was caught as she was >leaving< the US - her parents went frantic because she was also held incommunicado with anyone including her embassy.
