DOJ ask Supreme Court for 'immediate intervention' on immigration ban, documents show

The Trump administration has told the Supreme Court that a lower court ruling earlier this week altering an executive order on immigration would bring thousands more refugees into the county and requires the justices’ “immediate intervention,” according to filing documents obtained early Saturday by Fox News.

In a victory for the administration, the Supreme Court late last month lifted key components of an injunction against President Trump's temporary travel ban on refugees and visitors from six mostly-Muslim countries.

Since the Supreme Court has ruled, shouldn’t the plaintiff be required take the appeal to the Supreme Court?

As I see it, the lower courts have been superceded and are out of the picture.

The Trump Administration should just say “SCOTUS has ruled and we do not recognize the lower court’s ruling on this. The rules about individuals who may travel from these countries is unchanged from when SCOTUS issued their ruling.”

Period.

Please Supremes, haul those Hi judges back to DC and ask them to explain themselves. Tell them to arrive in 2 days and pay all their own expenses.

“Judge” Watson is a non-white drunk on his power and determined to never let go.

He was slapped down once before in a 9-0 decision of the SCOTUS but he didn’t take the hint.

Third Worlders are like that. He’s not going to stop, because in his culture, that means you’re weak and if you are weak, you’re dead.

This is his little war against whitey as exemplified by Don Trump. He is saying there’s nothing you can do to prevent us from taking over, we don’t care about your gringo rules, we will twist and distort them endlessly until we are in power.

That’s what he’s doing. Nothing short of the Congress removing him from his position for abuse of power will stop him.

The Federal courts are inferior to Congress. Only the SCOTUS is a Constitutional entity inferior to no one. They can only issue decisions which the lower courts have to respect.

Congress has to impeach and remove him. This was fairly common in the 19th century but not in the last 100 years. It's seen as Draconian now which is ridiculous. Alcee Hastings was a convicted felon before he was removed as a Federal District Court Judge.

And long term the Congress needs to draw boundaries around this kind of behavior. But they won't, especially when it comes to Executive Orders, which are a bit Constitutionially suspect themselves, but not this one.

The court, in a notice on Saturday, said a response to the motion for clarification "is due on or before" 12 p.m. EDT on July 18.

The government therefore respectfully submits this motion for clarification. In the alternative, the government has filed a notice of appeal, and this Court may grant a writ of certiorari before judgment, or even a writ of mandamus, and vacate the district court's order insofar as that order granted respondents' motion to modify the preliminary injunction. In the event that the Court would prefer the government to seek review first in the court of appeals, the government requests a stay pending such an appeal. In all events, the government respectfully requests a temporary administrative stay of the district court's modified injunction pending this Court's disposition of this motion. Disrupting the government's implementation of the Order (which the district court's order is already accomplishing) is entirely unnecessary; once the Court rules, the government can address any aliens who would have been affected in the interim.

They are issuing these "opinions" (actaully marxist policy to support open border for the globe) all without any knowledge of security issues facing the nation. There is a very SPECIFIC reason why this responsibility is given to Article 2

The GOPe led Congress - if they had a pair - should immediately pass a law and put on Trump's desk limiting the lower courts and tell them to BUTT OUT!. Only SCOTUS is out of reach of the Congress.

Finally. SCOTUS has _only_ jurisdiction, since it has _original_ jurisdiction. USDOJ has NO business allowing a lower court to say _anything_ in a case where a state sues the Federal government. I.e., as in this case.

Congress has Direct control over the courts and Paul Ryan and Mitch McConnell could stop this tomorrow, But they won’t.
