Calif. Regulators Temporarily Block Assault Weapon Rules

The state’s Office of Administrative Law released a two-paragraph notice, without explanation, rejecting the proposed regulations submitted by the state Department of Justice in May.

Chuck Michel, attorney for the National Rifle Association and its affiliated California Rifle & Pistol Association, said Becerra’s office inappropriately used a limited exemption in the assault weapons law to avoid public comment on the new regulations.

The Legislature allowed justice officials a limited exemption from the usual public comment for procedural regulations such as how gun owners would register their weapons, what forms would be needed and what fees would be charged.

But opponents say officials used that limited authority to avoid public hearings altogether on the substance of the regulations, such as what weapons or attachments would be covered.

Those proposed rules then were drawn too broadly and would classify too many firearms as assault weapons, opponents argued. Michel’s group counted more than 40 new assault weapons definitions.

“It seems like they’re trying to stretch the law to cover a lot of guns that shouldn’t be deemed to be assault weapons under the law,” Michel said.

Justice officials previously submitted similar proposed assault weapons regulations to the Office of Administrative Law in December but withdrew them in February. Michel said Becerra could appeal this week’s rejection by state regulators to Gov. Jerry Brown.

Brown signed six total bills last year to stiffen gun laws that are already among the strictest in the nation following high-profile mass shootings.

Judges in Sacramento and San Diego counties are considering whether to delay a law that goes into effect July 1 that requires gun owners to give up magazines holding more than 10 bullets.

Ultimately, I am not thrilled with the idea of hurting someone either. If I fight them, it’s all or nothing, so I’m not going to play nice. It’s all on the line.

I don’t want to harm them at all. Pulling out a gun wouldn’t be a position I’d like to be in either.

Hey, it’s their choice. I just want to be left alone.

I’ve had to pull a gun at work a few times in the last 19 yrs doing security. To say it’s a sh**** feeling is a huge understatement.

Thank God I’ve never had to pull the trigger. I talk tall alot but I really don’t want to hurt anyone I don’t have to.

Worked some security gigs too. I carried then. It would really have to be a no way out scenario for me.

I can just hear the D.A. now, calling me a liar.

Never had to draw my service weapon.

All that is so much BS....Half the people in the state have no idea what the hell is legal or not anymore. Even some cops have told he they can’t keep up with the never ending CA punitive rules, laws and regulations. All of these lunatic regulations are designed to punish the non-violent law abiding citizens. It’s effing disgusting.

I worked mostly in Santa Cruz, so I assumed I’d be crucified.

Been in TX for 6.5 years now...I’ve barely had to raise my voice but a few times. Granted, I’m not working bad spots like I used to.

To your first point (and I’m no lawyer) I believe to lose your gun rights it has to be at least a “serious” misdemeanor, not an infraction. But subsequent offenses could be a misdemeanor. An “imaginative” DA could try to say each magazine is a separate offense, and count a second mag as a subsequent offense, but I don’t know if it would fly.

Security can bite you on the ass if you’re not careful.

Some folks think it’s kind of a joke, but your life is on the line just like the local police or sheriff’s are.

I agree with your take on this.

I will say that many years ago I was arrested for having a gun in a tote bag in the back of my hatch-back vehicle. It was a Toyota Supra and there was no official trunk. It was in the area behind the back seat, inaccessible to the driver. The weapon was in the drive compartment by default, but I think most judges would have seen it as a reasoned place to store the weapon, equating it to being in a trunk.

When I explained to the D.A. that I had been working security locally, he quit the case. Not sure if he had a choice, but he did. It was the morning I would have had to appear before the judge, and I was happy not to have to.

True. Every year our block participates in "Americas Night Out" where there's a BBQ and the town cops stop by to talk to neighbors about their concerns. One Lt. got a call while there from an officer who had just stopped some methheads with long records carrying meth and a flare gun, and wanted to know if he should add a felon in possession of a firearm. The Lt. told him to go ahead, and I asked if a flare gun was a firearm under CA law (as far as I know it's not). His answer was "well, it's a gray area. It may get thrown out, but do you really want a methhead running around with a flare gun? At least he won't be tonight."

You just knew years ago when the politicians in Sacramento started going after even cosmetic accessories, grips et al, they were not going to stop at anything until they ban everything. That’s the goal. They couldn’t care less about the safety of it’s citizens and they prove this daily.

Years later, it’s just become an embarrassing spectacle of absurdity to the point Americans in others state justifiably look at CA as a threat to free people everywhere.
