The National Security Council cannot hand over records relating to former National Security Adviser Susan Rice’s surveillance of Americans, because they have been moved to the Obama presidential library and may be sealed for as many as five years, conservative watchdog Judicial Watch announced Monday.

Those documents are government documents, therefore documents of the people, and must be seized from Obama’s control.

If the docs are sealed for 5 years then one can’t prove the unmasking, but then one cannot also disprove it. That means it can be used as a club to beat the Dems with, charging widespread surveillance of anyone and everyone. Straight from the Dems playbook...

There is a Hugh and series difference between the N.S.C. and the NSA, who I am sure has the documents as well.
There is no question in my mind that all documents will mysteriously disappear. And rather than Republicans issuing court orders to preserve the integrity of these documents, they will slow-walk any comment and allow their good buddies, the Democrats to - once again - get off scot free.
There can be no mistake that the distinct lack of any Republican action is deliberate and willful. Sure they may come out eventually and make some phony statement, but we all know that if we're just now reading about this, it's too late. The documents are long gone. Anyone seen Sandy Burger?

Well there is a recourse. The response to Judicial Watch was a FOIA request, and even if they had the documents they don’t have to comply right away - if at all. But there is recourse, according to this link from Big League Politics. The records are currently at The National Archives, because there is no Obama library at this point. It hasn’t been built yet. But those records are still susceptible to a congressional or DOJ/FBI investigation subpoena:

They have no right (that meaning little or nothing) to remove the *requests* for unmaskings.
