Jarrett: Mueller Needs to Resign – “This Is the Kind of Stuff Over Which Lawyers Get Disbarred”

FOX News legal expert Gregg Jarrett suggested today Robert Mueller should disqualify himself from special counsel due to his relationship with James Comey.

The special counsel could not find any evidence of collusion between the Trump campaign and Russia so now they are going for obstruction of justice charges according to the latest deep state leads to the liberal media.

Donald Trump responded tonight to this ongoing witch hunt.

Gregg Jarrett: If you look at the special counsel statute it says you cannot serve as special counsel if you have a personal relationship with someone who is central to the case. If this Washington Post story is true, it’s now Trump against Comey. Comey is now the star witness, the key witness against Trump.

Well, guess what? Comey and Mueller are longtime close personal friends, partners, allies. They were joined at the hip at the DOJ and FBI. It’s a mentor-protege relationship. How is this fair to Donald Trump because Mueller is now going to decide whether to believe his good friend or the man who fired his good friend… … This is the kind of stuff over which lawyers get disbarred. If (he) does not resign then Rod Rosenstein out (sic) to fire Mueller.

Those rules are only enforced against Republicans, who are the only people who take them seriously. For the MSM-Democrats, they are just political tools to use against the opposition; otherwise, they're not even toilet paper.

Maybe the goal is to give immunity to Comey. It seems immunity was passed out like Halloween candy in the Clinton investigation.

After Comey is protected, then there will be a finding of no crime. Immunity is too easily subject to corruption. At least local prosecutors have to face elections.

Jarrett assumes or takes as correct, news reports that Mueller is investigating whether or not Trump's firing of Comey is an obstruction of justice.

If Mueller does not have that investigation in view, how would that affect Jarrett's analysis?

Canon 9 of the ABA Model rules of Professional Responsibility requires lawyers to avoid even the “Appearance of Impropriety.” This has been adopted by most states.
This would include involvement in a case involving a close associate of Comey.
I don’t know what state Bar he is a member of, but people living in his home membership state should file grievances against this scoundrel for disciplinary action.

You didn’t ask me, but Mueller is in an egregious conflict of interest position, really, to me, so bad that his very acceptance of the position in the first place is proof positive thereof. We don’t even have to get into what Mueller claims license to investigate (today).

Mueller and Comey are very close friends. Not just professional buddies. The families have gone on vacations together. This is a longstanding buddy-buddy relationship that is specifically prohibited under the “special counsel” regulations (importantly, I do not know if those regs are “laws”, “statutes”, or just “internal procedures”) Comey has described Mueller as his “mentor”.

There is nothing partisan about this. It’s a black-letter disqualifier for the S-C position for Mueller. He should have been disqualified after no more than 30 seconds of consideration and why he wasn’t I will never know without constructing a four-level deep conspiracy theory.

Both are dirty. Both are colluding to harm Trump. Both should be the subjects of investigations to determine if they have any culpability under the sedition statutes.

Comey is an investigator, actually the boss of an institution that has thousands of investigators.

I think the "fact" that leaking of the "memo" that prompted the appointment of the special counsel" is a fiction. It's a flase narrative designed to put a drag on Trump.

Accepting your premise, if Comey is none of those, then Mueller is not conflicted.

But AFAIK the first of the two salient items in the obstruction allegation is Comey’s variable recollection of “I hope you can see your way to ease off on Flynn” and exactly how one should parse and nuance that comment. How can Comey not be the critical witness in that piece of the investigation?

The second item of an obstruction allegation is Comey being fired as a means of quashing the Russian (or any other) vector of the investigation. How Comey cannot be a witness to his own firing is, to me, hard to fathom.

Thirdly, there would be no Mueller nor any other investigator had not Comey leaked his memo indirectly to the NYTimes...as he admitted and as he admitted as a means of producing the result of having an investigator. Comey’s leak is pretty much a crime as far as I’m concerned as it’s the dissemination of gov’t property and was probably composed on a gov’t laptop. So Mueller’s presence is in effect the spawn of a crime. I’m not sure how that affects this situation but generally, the law does not like recognizing the result of a crime as anything but something to be remedied. No conflict here, more like invalidation.
