James Comey asserted in his extraordinary testimony before the Senate Intelligence Committee that the director of the Federal Bureau of Investigation is authorized to override Justice Department oversight procedures, a questionable claim which if true would raise serious questions about long-standing rules aimed at preventing abuses by federal law enforcement officials.
The former head of the FBI told the Senate panel that he believed he had received a direction from the president in February that the FBI end its investigation of Michael Flynns alleged involvement with Russiaa direction with which he and his kitchen-cabinet of FBI senior leadership unilaterally decided not to comply. The Comey cabinet then decided that it would not report the receipt of this direction to Attorney General Jeff Sessions or any other Justice Department superior.
The group decided that it could override standard FBI protocol and possibly legal obligations to report the incident because of its expectations that Sessions would recuse himself from the Russia matter, although that recusal would not come until weeks later. The Comey cabinet also decided that it wasnt obligated to approach the acting Deputy Attorney General because he would likely be replaced soon.
We concluded it made little sense to report it to Attorney General Sessions, who we expected would likely recuse himself from involvement in Russia-related investigations. (He did so two weeks later.) The Deputy Attorney Generals role was then filled in an acting capacity by a United States Attorney, who would also not be long in the role, Comey said. After discussing the matter, we decided to keep it very closely held, resolving to figure out what to do with it down the road as our investigation progressed.

He would have been very comfortable ‘educating’ Trump that Trump’s request to stand down on Flynn was improper, and not the correct procedure.

That’s been the problem with Comey since he was in New York as the Federal DA for southern NY.

He actually thought he was the political equal of the President and thus the President answered to him.

Besides being subject to Nondisclosure Agreements, Comey falls under federal laws governing the disclosure of classified and nonclassified information. Assuming that the memos were not classified (though it seems odd that it would not be classified even on the confidential level), there is 18 U.S.C. § 641 which makes it a crime to steal, sell, or convey any record, voucher, money, or thing of value of the United States or of any department or agency thereof.

From what I saw yesterday and read about the aftermath of Comey’s testimony, it’s clear to me that this guy is completely ill-equipped to work for anyone who has spent a career outside the Beltway swamp bubble.

Hoover had taken the precaution of digging DEEPLY on every person who assumed the presidency, or was a serious contender, and having enough dirt to effectively hold a sword over their heads, should they try to interfere with the activities of the FBI. This gave Hoover INCOMPARABLE power over the decades he was in office.

If Comey WAS was afraid of Trump it was because he “knew” he had been caught at some illegal activity. He knew he was guilty and that Trump was going to confront him.
For those of you who haven’t seen it, I highly recommend the very funny social satire of the comedy movie The President’s Analyst (1967).
It is incredibly prescient about out of control police and intelligence agencies, both US and foreign, and a monopolistic corporation.
With a modern rewrite, it could accurately reflect what we are seeing today. Though it would also have to incorporate other movies, such as Enemy of the State (1998).
Our intelligence community has become a political arm against the American people and no longer deserves any respect.
