Leaving the Paris climate deal will take the U.S. years: Juncker

BERLIN (Reuters) - Europe must make clear to the United States that quitting the Paris climate agreement is not a straightforward process, and that fully leaving the deal will take years, European Commission President Jean-Claude Juncker said on Wednesday.

The claim being made by news outlets -- and it will be the next line of attack, so get ready -- is based on an end-run around the Constitution made possible by George Bush, in which the Senate ratified the UNFCCC.

That treaty did NOT obligate the United States to any specific plan, and there was a pledge made by the Bush administration at the time that the United States would submit any actual commitments made under the UNFCCC to the Senate for explicit ratification.

Barack 0bama broke that deal. But that does NOT mean that the US is committed to Paris. We are still in the UNFCCC; the Senate should rescind that Treaty immediately. Barring that, the matter will go to the Federal Courts, however, the Supreme Court has historically taken sub rosa commitments made by the President to the Senate at the time treaties have been ratified as binding on the interpretation of the treaty. As ratified by the Senate at the time of the Bush Administration's entry into UNFCCC, a Paris-like agreement could not have been considered an extension of the treaty.

The bottom line is that is simply FALSE to claim that Barack 0bama's subversion of both the Executive's commitment to Congress and the Constitution should be assumed binding. It should, in fact, be assumed NOT TO BE.

The funny thing is he thinks its true or if he says it and enough people pick up the chorus it can be made true. Sing along and dance along its MAGA fools! This guy’s more immediate need is to figure out which way is east.

John, I WAS IN NAM, Kerry did NOT have the power to sign off on ANYTHING....especially NOT a "treaty", which this abomination most assuredly is !

We dont know the “ details” about what commitments obama made
( just like obamacare and the Iran arms deal and the muslim refugees we agreed to accept from Australia and the last minute sanctions on Russia and...

Nor do we know yet if the Senate will,grow a spine and back the POTUS and the people and refuse to cooperate in an international agreement what was un constitutionally imposed

We are not a vassal state of the EU

Trump could have some fun—notify Juncker that any act to enforce the treaty on any citizen, corporation or agency of the US will be treated as an act of war.... :-)

Trump has already sunset EPA regs that put us outside Paris Accord.
