That is at BEST questionable.
They do have appellate jurisdiction over military court martial decisions and always have.
However, seeing as how the US military has almost all of the heavy weapons, it has always been the past practise of the courts to tread lightly, since they really can't enforce their dictates under such circumstances.
Recently, the Obama Administration (?) gave the Federal courts authority to initiate atrocities charges if the military courts do not act in a specific situation...an HUGE break from precident. As Commander in Chief of the Military, it was his prerogative. This could change with the stroke of a pen on an EO. Again, however, since Congress determines the jurisdiction and scope of actions of the Federal courts, there is some question of whether or not Obama's actions were legal.
Bottom line is that the Federal courts have usually stayed out of such matters. You don't want to p!$$ off the people who have all the guns and answer only to the executive branch. i don't expect that will much change since even though maybe corrupt, Federal judges aren't usually that stupid.
