Former Acting Attorney General Sally Yates infamously refused to enforce President Trump's executive order on immigration, which banned immigrants from seven Middle Eastern and African nations. Because of her refusal to comply with the order, Trump relieved her of her duties.
At a Senate Judiciary subcommittee hearing Monday, Yates stood by her actions, insisting she believes the travel ban is intended to discriminate against Muslims. She could not in "good conscience" defend it and or send DOJ lawyers in to defend it.
"I was not convinced it was constitutional," she told Sen. John Kennedy (R-LA). "There was no way in the world I could send folks in there to argue something we didn't believe to be the truth."
That's when Kennedy challenged her assumptions.
"Who appointed you to the United States Supreme Court?" he asked her. "At what point does a statue or an executive order become unconstitutional?"
Yates said she believes it is the responsibility of the attorney general to make those conclusions. As for the travel order, that was not a decision she "took lightly."
To the moral Relativist, no culture is better or worse (except ours) than another. Relativism rationalizes public services for illegals, regards slave nations as equal to free republics, and the admittance of murderous muzzies.
The Relativist denies the existence of the Laws of Nature and Nature’s God, and with it, our Declaration of Independence.

The Supreme Court does NOT have a Constitutional mandate to definitively determine Constitutionality of an act of one of the other branches. That characteristic was assumed by Chief Justice Marshal and not universally accepted at the time but by continuing to claim the ultimate power in the American system. the Court eventually got its way.
We can see that in Roe vs Wade.

There is an old book about the notes during the debates on the Constitution. It is the best "brief" I have ever read.
I think the title is "54 men and the Constitution"...based on the notes of Madison (I think that's pretty close to the title)

It addresses as a problem...the Supreme Court has no check.
This also addresses what would happen if there were more poor people and the power they could wield. We saw that with the election of Obama.
The book is inexpensive. Well worth the read.
