Attorney for United Airlines passenger Dao says there will 'probably' be a lawsuit

An attorney for Dr. David Dao, the passenger at the center of the United Airlines incident, said that there will likely be a lawsuit as a result of the incident.

"I think corporate America needs to understand that we all want to be treated in the same manner with the same respect and the same dignity that they would treat their own family members. If they do that, wouldn't it be great? So, will there be a lawsuit? Yeah, probably," attorney Thomas Demetrio said during a press conference on Thursday.

Wait until the other videos come out that show Dao plotting the scheme while on the phone, telling somebody to contact a lawyer.

Not so fast. Here's a simplistic view of how I would see this unfolding:

Step 1: Plaintiff Dao files lawsuit against United.

Step 2: United files a third-party claim against the Chicago aviation security police who dragged Plaintiff Dao off the plane. United claims that they have no responsibility for how Plaintiff Dao was treated by the aviation security police, and therefore they are not responsible for any harm suffered by Plaintiff Dao. United also claims that the aviation security police caused tremendous damage to United's reputation in the process.

Step 3: United files a counterclaim against Plaintiff Dao for failing to abide by the terms of his agreement whereby he agreed that United could bump him from the aircraft for any reason whatsoever.

Even a case that seems like an obvious claim is never simple.

regardless of who is right or wrong, Dao will get a nice payoff because United can’t afford any more bad PR, so they will settle this ASAP.

A judge with any sense would dismiss this case at the outside.

Once this guy was informed by United that he would not be allowed to fly on their plane, he needed to vacate the plane. It’s not his plane. He was a trespasser at that point.

At that point, he could sue them for the cost of his ticket and maybe for other costs from the cancellation of his ticket. But he doesn’t have the right to possess the airplane and occupy a particular seat to the exclusion of United and law enforcement officers.

Step 4: United settles with Dao for a tidy sum (several million dollars, unlimited first-class flying - no drag-offs, no baggage fees) and a heartfelt apology, laser-engraved on a titanium plaque, posted in the O’Hare terminal for all to see.

United may or may not get out of a lawsuit cheap. But whatever they pay in a lawsuit, I’d bet they lose more in ticket sales....

1. Any settlement will be a quiet one, and it will likely involve payments from at least three parties: United, the aviation security police, and Dao's own insurance carrier.

2. Dao may have to agree never to fly United again.

I would have to agree with that. United did not drag him off the plane, airport security did. Dao violated the terms of the contract on his ticket. He might not have liked it but it is the truth.

Yes, United was stupid, bureaucratic and insensitive

BUT - when they called TSA and the local airport police, it was no longer in United’s hands. United did not administer a beating on a peaceful, elderly citizen.

Just more evidence the Republic is turning into a police-state in the name of “security.”

Knew a woman 45 years ago who would intentionally fly on flights likely to be overbooked. BECAUSE airlines (her favorite was Delta) would offer incentives to deplane. The offers would keep getting sweeter until they would announce that ONLY the first three hands up would get the offer - so 'get ready to put your hand up'... offers of cash, round trip tickets to Hawaii, nights in a hotel etc.

Of course back then a person could buy a ticket with cash 8 minutes before the plane took off, run out on the tarmac and up the stairs and fly off.

The attorney saying “Yeah, probably”, probably means he’s fishing for a settlement.
