At 11:00 a.m, the Senate will VOTE on cloture for Exec. Cal. #33, Neil Gorsuch, of Colorado, to be Associate Justice of the Supreme Court.

If I am not mistaken, as I often am, still in store for 30 Hrs of debate. Vote for Gorsuch will not be until tomorrow :-(

I misspoke. I think the precedent raised by Schumer was Fortas. Fortas was unacceptable to a majority of Senators too, but the senate voiced that with a failed cloture vote rather than an outright rejection.

Does this also mean the “nuclear” option of 51 votes also applies to the actual confirmation of Gorsuch?

The Dems will drag this on to satisfy their base. Cornyn, not one of my favorites, is doing a good job explaining what really happened in the context of the history of such votes.

No, it has always been a simple majority for confirmation. Being able to get to that vote was the point of contention.

Confirmations have always needed only a simple majority (51), that does not change.

The Fortas ‘filibuster’ was different than this, because Fortas was already a sitting Associate Justice on the SCOTUS, he was being nominated to be Chief Justice if I’m not mistaken.

The Reps don’t have to use all of their 15 hours. Gorsuch will be confirmed tomorrow no matter how long it takes.

the Democrats will probably take that entire 30 hours of debate before the vote can take place.

Then I hope McConnell does not adjourn, and makes them stay up all night.
