The answer is no...
Starting at 14 there needs to be 4 years different in age not to be rape...
She is 14, he is 17 or 18, she can consent to have sex..
Someone on FR, with presumably much more knowledge of the law than I have, said recently that Maryland law says it is statutory rape only if the older participant is 4 or more years older than the other participant. It was stated that the older of these two animals is 3 years and some number of months older than 14.
Are the suspects over 18?
Also, there can be mitigating circumstances. I’ve known guys that were completly clueless about sex by 18 and girls that were dangerous at 13.
If she was texting suggestive pictures of herself to boys in the throes of puberty, if I were the judge, I’d find them not guilty and consider her the “older” person, even if not chronologically. Now, if they were not public school students, I retract that remark.
I attended public school. Girls can be dangerous. Seriously. The reason there are more men in prison than women is that men and women tend to act badly in different ways. When men act badly, they do things that land them in prison. When women act badly, they ruin people’s lives. The latter usually does not involve incarceration.
Maybe not with the younger guy.
Consent laws allow some leeway in like-age sex, usually with a 3 year age disparity. Depends on the State.
With the older guy it is definitely statutory rape though ... even if they can prove consent.
As I understand it, the statutory rape definition in Maryland law has an exclusion for less than 4 years age difference provided both parties are over 14.
In MD, this is not statutory.
