The American Civil Liberties Union announced Saturday evening that a federal court in New York had issued an emergency stay on President Trump’s executive order banning immigration from seven predominantly Muslim countries. The court’s decision, which will affect people who have been detained in airports, came after the ACLU and other activist groups filed a class action lawsuit on behalf of two Iraqis who were held at John F. Kennedy International Airport in New York as a result of the order.
“I hope Trump enjoys losing. He’s going to lose so much we’re going to get sick and tired of his losing,” ACLU national political director Faiz Shakir told Yahoo News shortly after the decision was announced.
The White House did not immediately respond to a request for comment about the court ruling.

While the case is pending, Trump should simply send all the ones we won’t take to Canada. Their leaders specifically asked for this to happen, so just take them up on it. Provide transport and everything for now, in a very public manner.

How does the Court make a finding of fact that admitting whole class of refuges would not pose a risk to the security or welfare of the United States without evidence or even knowing who they are? This will likely be vacated on an expedited appeal.

ACLU has taken one step. It will go to the Supreme Court but won’t make it there until there is another Constitutionalist on the Court. Then, of course, it will depend on Kennedy who loves to be the Swing Vote and Roberts who has shown us where his heart really lies. I am afraid we won’t get a reliable Constitutional Court until two of the dogmatic leftists are replaced.

The problem is that Trump is moving faster than his legal team. Unfortunately he does not have the people in place to defend his actions. He should slow down a bit so he can legally defend the executive orders he signs.
Eric Holder is still in contempt of court of Congress but there’s no one to enforce it. So who is this judge going to send to enforce her ruling?
A President can’t change or create law.
So if someone says they’re here lawfully then a court can rule on that.

They probably did it last minute to make it harder to setup 1000s of people as poster children at the airports for the new policy. Sosos would have payed people to fly in and get suck in very large numbers.
