Sen. Minority Leader Chuck Schumer (D-N.Y.) said on Sunday that he is prepared to leave open the ninth seat on the Supreme Court.
If the nominee is not bipartisan and mainstream, we absolutely will keep the seat open, Schumer told CNNs State of the Union.
ADVERTISEMENT The Supreme Court vacancy has been open since last February, when Supreme Court Justice Antonin Scalia passed away.
Schumer said he is prepared to fight "tooth and nail" should Trump not choose a mainstream nominee.

With moderate Republican senators, Senator Schumer could do some boat rocking.
Anyone else think that the Dems might be planningood on/hoping for another “untimely” death of a conservative justice, tipping the balance to the left 4-3?
I wonder if he is aware how he plays to the some recently red parts of the country where many of his members face re-election in the mid-terms? That nasal New York voice talking about the “main stream” as if he represents it. Have at it Chuck, you may find yourself abandoned rather quickly.
If the Senate is controlled by the Republicans, how can one solitary Democrat obstruct and hold back the nomination.

Translation: Schumer said he is prepared to fight “tooth and nail” should Trump choose any nominee who is not a “living constitution” progressive nominee.
Nothing prevents the court from operating with 8 justices. Or 7. Or 6.
Schumer is the poster boy for Upstatehood.

Harry Reid’s nuclear option of requiring only a simple majority of 51 votes to pass legislation doesn’t include approving Supreme Court nominees. I don’t know if changing this to a simple majority requirement can be done or not. But, if not, then the Dem’s can indeed block any Republican nominee as long as they stick together.
He and 40 other senators do.
Then its time to focus on 2011 and 2020 to remove them and other RINOs
