Recount 2016: Jill Stein Cannot File Direct Request For Recount In Pa, Must Take it to Court

Jill Stein posted to her Jill2016 website that she had raised enough money to “file” for a recount in Pennsylvania. However, the Green Party candidate left out some key details about the filing of recounts in Pennsylvania that many of her supporters likely would have wanted to know before donating. For example, candidates cannot file a direct request for a recount in the state and instead must appeal the election in court.

She claimed “data” has suggested a need for recounting “machine-counted” votes in these particular states, which also happen to be states that Trump unexpectedly beat Clinton.

Should all three states be overturned in a recount, Clinton would have enough electorates to win the election. However, Stein did not make the recount process clear for her donors. Her outline makes it sound as though a candidate can simply file for a recount if they raise enough funds for the filing fee.

While the filing fee and request is all that is needed in Wisconsin, her second state “funded” is much more complicated. Pennsylvania does not allow candidates to file a direct request for a recount, according to the Pennsylvania Election Code. Instead, the filing fee is simply the amount needed to appeal the results.

During the appeal process, the court may determine that a recount is necessary.” Per Pennsylvania regulations, there is only one way remaining for Jill Stein to get a recount in Pennsylvania and it is a complicated process. BillyPenn reports that Stein would have to file for a court appeal and present a “prima facie case” showing that voter fraud took place. While prima facie has a lower burden of proof threshold than “beyond reasonable doubt,” it is still significant. Stein would have to prove in court that fraud was “probable.” This is going to be very difficult given that even the computer specialists recommending the recount say there is no proof of hacking or fraud.

However, since Stein has funded and initiated the effort, Elias says that Clinton will participate to ensure fairness.

Stein has maintained that the effort is not designed to overturn the election results, but rather to ensure transparency in the voting process. Stein has even criticized Clinton for joining her efforts so late in the game, calling her “on-again, off-again about democracy.”

She also has to show material harm... And with a whopping 1.something percentage of the vote any honest judge will toss her request. She cannot show that any fraud found would change her losing the election. This whole thing is just pandering to the radicals to keep them wound up and try to delegitimize Trump.

I would suspect this is irritating Trump more than a little bit. Legally he can not tell his Attorney General to go after Hillary or not. That would be undue influence. He can talk all he wants to to his attorney general to be.

If this crap keeps going on, I would suspect the conversation would be as follows, “when you are attorney general, enforce the law to extremis, investigate and prosecute if warranted and do not even tell me about it.”

Hillary is playing a very dangerous game that she will lose. She is trying to usurp the president elect of the United States. She is still playing for all the marbles and she will lose. If by some insane chance she wins, the next civil war just started.

Yes it is, Philadelphia excepted. The rest of Pennsylvania is populated by people that act like Texans, but the really need to work on that damn accent they have. :)

Nope! I have known a few that I liked although I did not avail myself of their services. They have much more honor than Jill Stein and were much better looking!

I might have misunderstood but I thought the idea was that investigation into PA voting would uncover Dem voter fraud and incriminate HRC.

PS - just a rumor(take with a huge bag of salt), but some people have gone as far as to say that HRC really only got ~10 million votes nationally and the rest were fraud. Lol could you imagine??

So, judging by this and how fast WI rolled over, if PA ever gets to the point where the court orders recounts, we will know the fix is in.

Why are the Trump team lawyers not fighting this coup attempt in court? tie it up in court.

They should have hired me instead of all these dummies just standing around letting soros and Hillary steal the election.
